The dormant Baronies of Gardner of Uttoxeter (1800 [I] & 1806 [UK]) have many living dynasts, but the title has been officially dormant since the death of the 3^rd Lord in 1883. The extant members are still faithfully included in modern editions of Debrett’s. Burke’s included the family through at least 1959, but by 2000 Burke’s had given up on them and no longer include them.

There are some interesting aspects to the family genealogy:

1. Alan Hyde Gardner, 2^nd Lord Gardner (5 Feb 1771-22 Dec 1815), married firstly 1796 (div 1805) Maria Elizabeth Adderley, later wife of Henry Jadis. Maria Elizabeth had a son, Henry Fenton Gardner, born in 1802, who as early as 1814 was registered at a school with the surname “Jadis”. Henry claimed the Baronies,having been born during his mother’s marriage to the Baron, but it was at length determined by the House of Lords in 1828 that he could not be the son of the 2^nd Lord, who was abroad during the time when Henry must have been conceived. Cokayne notes that this was one of very few times when they overcame the legal doctrine that a child is presumed to be the son of its mother’s husband. Cokayne gives several other examples affecting Peerage titles in the article on the Earls of Aylesford.

2. Alan Legge Gardner, 3^rd Lord Gardner (29 Jan 1810-2 Nov 1883); his right to the Peerage was confirmed 1828; he m.1^st 1835 Hon. Frances Margaret Hughes (12 Oct 1814-8 Dec 1847); he m.2^nd 1848 Julia Sarah Hayfield Fortescue (d.3 Nov 1899), an actress.

While the first wife was still living, he had at least one, and apparently two, sons with his future second wife. Since legitimization by subsequent marriage was not recognized for British or Irish peerages, these sons could not inherit the titles. The elder son was later created Baron Burghclere.

3. On the death of the 3^rd Lord in 1883 the titles became dormant. They were at once claimed by Alan Hyde Gardner (1836-1899), grandson of the second son of the 1^st Lord, but they were also claimed eventually by Alan Hyde Gardner (1878-1949), another descendant of the second son of the 1^st Lord, disputing the claims of his senior cousins. The junior claim, as Cokayne says, “…could obviously only be made good by showing the bastardy of the [senior] claimants...” L G Pine was of the opinion that there must have been some question about whether some of the marriages of the senior claimants in India, “ … i.e., whether they could be considered in English law not Christian but polygamous marriages.”

Interestingly, the Indian Gardners often married other Gardners, both descendants of the 1^st Lord and also some collateral relatives.

The senior claimants maintain their claim, but I do not know whether they have actually presented a claim to the House of Lords. Here is an article about the present claimant.

In 1972 L G Pine wrote that he had knowledge that the junior claimants were considering making a formal claim for the titles.

I include a genealogy below, since they have not been in Burke’s for some time, though as I said they are in Debrett’s. I will omit most living member, since this is a public forum.
