Good news here as the earldom is a bit thin on male heirs. Are these
Tolstoys, the genuine counts or from the branch of the writer whom I
believe assumed the title of count? Please for give me if this is an
ignorant question!

Her father is Count Nicholas Tolstoy-Miloslavsky, son of Count Dmitri
Tolstoy-Miloslavsky by his former wife Mary (later wife of the writer
Patrick O'Brian of "Master and Commander" or Aubrey-Maturin fame). He
inherited his stepfather's fortune, after a bitter legal fight with
Lord Aldington, which made him financially secure. (Aldington never
got a penny, I believe).

Eldest daughter Alexandra is now separated from her Uzbek husband

"A smart match for Xenia

Stepping out: Lord Buckhurst and Xenia Tolstoy
Historian Count Nikolai Tolstoy's adventurous daughter Alexandra broke
with convention when she married a penniless Uzbek horseman after they
met on her travels.
But her Downe House-educated sister Xenia may have her sights set on a
more traditional match.
For pretty Xenia, 28, once the girlfriend of the Duchess of York's
half-brother Andrew, is stepping out with Lord Buckhurst.
Old Etonian Will Buckhurst, the 29-year-old son of stockbroker Earl De
La Warr, is a successful hedge fund manager at City firm Cheviot and
stands to inherit his father's 6,000-acre estate in East Sussex.
He and Xenia have been spotted together at society parties over the
summer. Like her sister, Xenia has a taste for adventure. She spent a
gap year working with children in Kenya before setting up an orphanage
in Estonia."

Sorry, that is Nikolai Tolstoy (b 1935) son of Count Dmitri Tolstoy QC
(md 1934, div 1942) Frieda Mary Wicksteed.

Here is some more information on him. His wife's name is Georgina
Katherine Brown (b ca 1950) who married her husband in 1971

Here's a photo
http://3.bp.blogspot.com/_j2dLi5ZUlsk/SB98GYS0J5I/AAAAAAAABAI/19ghs3LaNVA/S240/nikolai+tolstoy.jpg

http://en.wikipedia.org/wiki/Nikolai_Tolstoy

"He is the head of the senior branch of the Tolstoy family, being
descended from Ivan Andreyevich Tolstoy (1644-1713). It is
occasionally incorrectly assumed that he is a direct descendant of the
famous author Leo Tolstoy (1828-1910), who was however descended from
Pyotr Andreyevich Tolstoy (1645-1729), younger brother of Ivan. Tsar
Nicholas II declared his intention of recognising the title of Count
for his Chamberlain, Pavel Tolstoy-Miloslavsky, (Nikolai's great-
grandfather), but this was deferred due to the growing crisis in
Russia. When the last Emperor's cousin, the Grand Duke Kiril
Vladimirovich of Russia succeeded to the Imperial inheritance and
rights, he confirmed Pavel Tolstoy-Miloslavsky's title, and this was
confirmed by the Dowager Empress Maria Fyodorovna, and the Grand
Duchess Xenia Alexandrovna of Russia and Grand Duchess Olga
Alexandrovna of Russia, Nicholas II's sisters.
Nikolai's father, Count Dimitri Tolstoy QC, escaped from Russia in
1920, and came to England where Nikolai was born in 1935. Count
Nikolai is married and has four children; Alexandra, Xenia, Anastasia
and Dmitri."

Actually, according to the announcement, Anastasia is older than
Xenia.

Keeping a roof on
Bankrupt and mired in lawsuits, Nikolai Tolstoy spent 10 years
fighting to keep his family home, reports Carey Scott of The Sunday
Times

"Throughout a bitter 10-year legal battle, contesting a £1.5m libel
damages award that Tolstoy was ordered to pay Lord Aldington in 1989,
their family home, where they lived with their four children, was
their only asset. The threat that it might be seized and sold hung
over them, says Georgina, “like the sword of Damocles”. Although the
house was in their joint names, the debt collectors could have forced
Tolstoy to sell in order to realise his half of the heavily mortgaged
house.

[snipped]

His dispute with Lord Aldington arose over a pamphlet Tolstoy had
written in which he accused the Tory peer of having knowingly sent
70,000 anti-communist Russians and Yugoslavs to their deaths at the
hands of the dictators Stalin and Tito in May 1945, when Aldington was
a commander in the British army in Austria. The jury’s libel award,
the highest in British history, vindicating Aldington, outraged many
in the Establishment, and friends rallied round to help the couple."

etc

"By 1995, the European Court of Human Rights had ruled that the huge
libel award against Tolstoy amounted to a violation of his freedom of
expression. Three years later, Aldington, who had refused various
settlement offers from the Tolstoys over the years, finally agreed to
accept the sum of £100,000. And luckily for them, when Tolstoy’s
mother, Mary, died in 1998, she left her son an unexpected and very
welcome sum of £145,000 from a family trust."

OK, Aldington did get quite a large sum according to this. Mea culpa
- most sources claim that he never saw the money.

"By a strange quirk of fate, in 2000, Tolstoy came into £1.5m —
precisely the amount he had been initially ordered to pay Aldington —
when his stepfather, the novelist Patrick O’Brian, died, and made
Tolstoy and his sister the main beneficiaries of his will. Tolstoy
also inherited the house in Collioure, in southern France, that he had
helped to build with O’Brian, the author of the Jack Aubrey sagas of
the Napoleonic wars.

“Some of the Aldington camp made sour comments,” says Tolstoy, “and
said I should give it all to Aldington out of kindness, but it was all
over by then.” Aldington himself died later that year.

O’Brian, who had also paid for the Tolstoys’ son Dmitri to attend
Eton, and left his royalties to Dmitri and his three sisters, was to
become Tolstoy’s next subject."

Nikolai's mother Mary (born Frieda Mary Wickstead) ran off with
O'Brian then Patrick Russ when her son was 3. They didn't meet for
years after that.
