From the Telegraph of 1 May 2012:

I thought I saw mention in the forward to the latest edition of Debretts that he had made one of the most distant successions to an earldom, does one really need to be on the Roll to be an earl? There isn't a seat to be had any more, still one supposes that if one succeeds to an earldom and one has a sister, then the latter might wish to be raised to the rank of an earl's daughter.

"does one really need to be on the Roll to be an earl?" To be officially recognised as a British peer and to demonstrate you've successfully established your claim as such, the answer is 'yes'. In this case he doesn't use the title so, for him perhaps, applying to be recognised as the 15th Earl is of no consequence. Maybe his brother and sister feel the same way too?

I quote from the Preface of the current edition of Debretts: '...the 15th Earl of Northesk who has succeeded his eighth cousin once removed. The new peer, who prefers still to be known as Dr Patrick Carnegy, is pursuing his claim at the Court of the Lord Lyon. This is one the most distant succession to a hereditary title since the death of the 10th Duke of Newcastle...' So who is to say that he is not pursuing his claim.

Quite. I did put 'perhaps' in my reply. We'll 'watch this space' as they say.

To update. The present earl's claim to the title was recognised by Lord Lyon in 2012 and he now appears on The Roll of the Peerage.
