Dear Residents.

In the last Management Committee it was discussed & decided that we will submit a complaint letter to TMC Commissioner, in regards to the 3rd lift & the discrepancy in the measurement of the flat. In this regards please find attached the letter & also please note that our Liftman will visit all the residents for the signature. Please cooperate by signing the letter,

Dear Residents,

 

Sign of from all residents shall add weightage to the complaint.

Request all to sign by Sunday.

It shall also then help us to move to the consumer court.

Dear Ivan, Sanjeeva,

Thanks for the initiative. It will be more appropriate if we attach Runwal construction letter informing that all area are appropriate and there is no discrepancy in the area calculation. That will be useful to prove that the builder is denying our claim.

Also, do we have any communication from the builder that two lifts provided are adequate? If so let us attach that also so that we can show that the builder is denying our claim.

Dear Shailesh,

Complaints to TMC are to strengthen our case.
We have already taken a legal opinion and we shall be providing all those evidence with hard core facts when we file in consumer court.
Already some consumer court judgments are in our favor.

Dear Shri Ivan, Secretary
             I have thoroughly gone through your proposed draft of complaint to Principal Secretary & Thane Municipal Commissioner. I wish to submit  following for your kind considerations, 
-- 1)These are administrative authorities. Issue in question is an existing occupied property. They may at the most punish the authorities responsible for approval, supervision of construction & final issue of "OC". They can't punish builder. At the most they may rectify the mistake done by administration by withdrawing OC (Occupation Certificate) and may declare the construction "illegal". This may result in issuing directions for withdrawal of services given by Municipal Corporation such as water etc and they may direct to charge penalty rate of property tax to the residents of "Illegal Constructions".  Ultimately sufferers  would be flat occupants. Do we want this? It is moving on the lines of "pure drinks"case. 
You are praying for financial liability against builder. This relief is not possible from quoted authorities. 
  --2) Secondly, if someone concerned takes-up & follows-up the issues of non-conformity of buildings of specified builder diligently then they might black-list the builder & may exercise stricter control for future constructions. Which is highly unlikely in view of current trends & practises adopted by these authorities. 
      Issue involved is breach of trust of consumers. Hence appropriate authority would be only Consumer court. Here penalty & financial burden may be enforced. Action for breach of trust  by government authorities against an influential builder is very unlikely. 
      Forwarded for a second thought over the issue.

Dear Mr Umare,

The letter to be submitted is to inform the issue that we are facing to the concerned authorities. , we are planning to go for a legal notice, in this regards we are gathering all the possible ways to put across pressure on the builder. when we go the legal way we will submit all the evidences that we have done from our side to get the Builder to rectify the situation. 

Please note all these are being done after serious legal consultations & not on adhoc basis, all the consequences for such a letter has been discussed & hence the letter. Plese note that in the same complex he has other towers comming up and also he has other
projects in thane , this will all come under serious scrutiny.
