Comment letter re Terminal Disclaimer rule

Dear colleagues:

Another sign-on letter, re the Terminal Disclaimer rule.  This letter is due July 9, 2024 (next Tuesday).  However, I’m going to be on vacation in Montana.  I may have to close signatures as early as Monday evening.  Don't know yet.

Thanks.  Lots of the other letters are making that argument.  In contrast, I'm the only person in the country with the expertise specific to the law of rulemaking.  So I'm keeping my focus on that.

The real audience here is OMB and SBA.  This letter is a catalog the PTO's contempt for the rule of law.  After we send it to the PTO, I will forward it to OMB and SBA, as "impeachment" evidence in their upcoming reviews of the fee-setting rule, and on-going review of the DOCX rule.

Maybe I missed it in your draft letter, but since the law is clear that each claim is judged for validity purposes independently of the others, it seems to me that the proposed rules making “unenforceable” all claims in any patent tied or at one time tied” to another patent in which even a single claim is held unenforceable is so directly contrary to statute and beyond court directive as to be beyond regulatory authority.   This requirement is not needed for the administration of the patent system at all.  Couching the requirement in terms of “unenforceability” rather than “validity” is simply disingenuous and smoke and mirrors.
