Maybe I missed it in your draft letter, but since the law is clear that each claim is judged for validity purposes independently of the others, it seems to me that the proposed rules making “unenforceable” all claims in any patent tied or at one time tied” to another patent in which even a single claim is held unenforceable is so directly contrary to statute and beyond court directive as to be beyond regulatory authority. This requirement is not needed for the administration of the patent system at all. Couching the requirement in terms of “unenforceability” rather than “validity” is simply disingenuous and smoke and mirrors.

Updated letter re the Terminal Disclaimer
rule. This letter is due July 9, 2024
(Tuesday). If you are waiting for it to be done done (except typos) before you sign, well, now it's time (I'm going to be in airplanes all day Sunday, and on bumpy roads most of Monday). The signature cutoff will likely be 9PM Monday (eastern).
