Quarterly Report on Pending Interferences

(1) Zombies: There is no interference in the period for filing a petition for certiorari.
(2) On petition for certiorari: There is no petition for certiorari from a Federal Circuit decision in an interference pending.
(3) On appeal to the Federal Circuit: There are three interferences on appeal to the Federal Circuit: 106,087; 106,109; and 106,123.
(4) Decided but not appealed: There is no interference that has been decided by the board but not appealed to the Federal Circuit.
(5) Awaiting decision in the first phase: There are three interferences awaiting decision in the first phase: 106,125; 106,126; and 106,127.
(6) Awaiting decision in the second phase: There is one interference awaiting decision in the second phase: 106,115.
(7) Awaiting decision on remand from the Federal Circuit: There is no interference awaiting decision on remand from the Federal Circuit.
(8) Pending in the first phase: There are four interferences pending in the first phase: 106,130; 106, 132; 106,133; and 106,135.
(9) Pending in the second phase: There is one interference pending in the second phase: 106,119.
(10)Pending but no publically available information There are two interferences pending for which there is no publically available information: 106,100 and 106,131.
Total: There are fourteen pending interferences, the same number as in my two previous quarterly reports.

Perhaps I should explain that EIC Sofocleous explained years ago on Rick’s list serve that interference numbers are assigned when a prospective/possible interference first reaches the board, not when an interference is declared, so the fact that Int. No. 106,131 has an interference number between interferences that were declared on 26 January 2021 and 21 June 2021 does not guarantee that it was declared between those two dates.

There were at least four new interferences declared in 2021 (106,130 on 26 January 2021; 106,132 on 21 June 2921; 106,133 on 21 June 2021; and 106,135 on 26 August 2021) and five if Int. No. 106,131 was also declared in 2021, so it would not be surprising if more interferences were declared in 2022.

By the way, you probably already explained this, but is it now a ratchet-down? That is, are things now such that the number of interferences can only only go down and cannot go up? Is it impossible in 2022 for a new interference to come into existence?
Or could there for example still conceivably be two pending patent applications even now in 2022 that have been pending since before the AIA happened, where an interference could be provoked and could then come into existence? Or maybe two reissues of pre-AIA cases, something like that, that could come into a new interference with each other?
