Dear Sir/Madam

What is the state of the Refund process?   When will I and the remaining 44 owners get the refund for the excess amount paid to Patel ?

Why are we being made to suffer on account of understanding or otherwise misunderstanding that has taken place between Patel Realty and the Association Members.     Kindly sort out the differences among yourselves and do not make us suffer due to your understandings or misunderstandings.

@Association Committee ........... What is stopping you from working out the differences and paying up what is due from Association to Patel Realty.
It is the association who had the MoU with Patel and you are representing the entire community and not a few members.

Association needs to also stand up for the members who are being denied refund from Patel.

Kindly close this issue and let us not suffer due to your understanding or misunderstanding with Patel,  If nothing is going to be done on this matter ,  kindly note that both the association and the builder Patel Realty are legally liable for cheating leading to the financial loss and harassment of those who have paid in excess.

Subsequent to below mail received from Patel Realty, please see my comments and questions below,  for which I request the committee to kindly take necessary actions.
  1. How does the association respond to the demand from Patel Realty?   Request association to kindly respond to them by email.
  2. Why is association protecting these 16 defaulters while doing nothing to protect the rights of the 54 owners who have made payments promptly and on time.
  3. What is the maintenance dues payment history of these 16 owners subsequent to association taking over from Patel .   Request association to share these details. 
  4. Are these 16 owners trying to absolve themselves of their liabilities to the builder and is the association helping them to do this under the umbrella of the MoU signed with the builder?
  5. What action has association taken or going to take against these 16 defaulters to ensure their dues have been paid.
  6. What actions can the association take to ensure zero monetary liability of the association with builder subsequent to handover.
  7. Why have the STP and Water Bills for Aug and Sept 2017 not been paid up while maintenance dues are being promptly collected from the owners.?
  8. What role does Suresh Iyer of A1203 have within the association since he has intentionally mislead the community by saying he got information that Patel would refund the dues amount by end November while it is now obvious from trailing mail that Patel expects the 15Lacs dues from association should be settled first.
I request the association to do the below :-
  1. Work out actions to protect the rights of the 54 owners who are suffering simply because they have paid up maintenance dues on time.
  2. Do the right thing both in letter and spirit of the MoU that the association has had with the builder .
  3. Be transparent with the community on the dealings that the association has had or is having with the builder.

Please note that amount due from the Association is Rs. 9 Lakhs towards Maintenance dues of Residents who have registered their flats. These details were sent to the Association on 31.08.2017 (mail attached herewith). Apart from the Maintenance dues, STP and Water bills for Sept 2017 and Water Bills for Aug 2017 amounting to Rs. 3,88,195/ (Reminder mail being sent on 31.10.2017-attached herewith ) are still due. These bills have been sent on regular monthly basis by Speed Post and by email.

Water and STP Bills for Oct 2017 are being sent today (08.11.2017) by speed Post and email

Please note that the association is not aware of any 19 lakhs due to Patel from association. We have received no notice or intimation regarding the same. Neither are any invoices raised.

Please appraise us as to how Patel Realty can have receivables from Smondo 2 Association? The only services we avail from Patel are the water supply and STP, both of which are paid by association duly. If any thing it is Patel who is having dues on the association for payment of maintenance for the unregistered flats which are still under the ownership of Patel reality.

I have already given plenty of reminders to Patel Realty requesting for this refund and still there is no response from Patel ,  as promised subsequent to the memorandum of understanding that Patel had with the Smondo 2 association working committee.

 

My wife ,  Pramila who is co-owner had recently talked to Sreelekha of Patel Realty enquiring about this,  and in the conversation Sreelekha  had informed Pramila that the reason the refund is being delayed is that Patel is still short of 19Lacs receivable from association.  Why is Patel Realty linking the refund of excess amount paid by me to amounts receivable from association  while on the other hand the association has stated to the community that they have nothing to do with the refund.

 

Why is the Smondo 2  association not paying the 19Lacs due to Patel Realty as has been claimed by Sreelekha  who represents Patel realty?    Kindly make matters clear to all the stake holders by replying to this mail.

 

What is this understanding between working committee members of Smondo 2 association and Patel Realty that has gone sour and in the process myself and the rest of around 54 members have paid in excess and are not getting the refund due.

Kindly note that this is pure harassment of  members who have paid in excess and the refund is therefore due with interest applicable from the date of signing the MoU with association.

 

Patel Realty should kindly refund the amount immediately and  Patel Realty may kindly reply to this mail and  reveal to the community what is this understanding and/or transactions that have taken place  between Patel Realty and working committee of Smondo 2 association which has led to Patel Realty delaying refund of payments due to excess amounts paid by around 54 members .

Please arrange to return the excess amount collected immediately and do not link this refund payment with the pending collections.
