Thank you all who have attended the meeting and sharing the MOM with us, otherwise it would have been difficult for us (sitting at long distance) to know about all the happenings going on.

What I understood from the second point, that we need not to pay the interest amount at the moment at least. Did builder confirmed this in writing or by any other means......? Is this relaxation if on individual basis...?

Please let me know about this, as I have also received a scan copy on mail of demand letter for payment of penalty, on request after making hundreds of calls to the builder.

We discussed on below key points-

 

1. Service Tax - Builder agreed they goofed up in service tax calculation that's why they are implying 97:3 principles. And Service tax amount is very less (as compared to other amounts) so its unlikely builder is trying to get money from us and keep in his pocket. 

 

I would suggest to read the paper mentioned @  Service Tax Calculation and Understanding . It's worth reading as per this document we don't need to pay the recent service tax requested by the builder.

 

2. Interest - Now builder has already sent the letter by mentioning the last letter is null and void. Few residents had conversation with builder and per them at this point of time builder is not asking for interest now and expecting to pay the interest at possession. We all believe interest component will again haunt us. So we need to come-up with the plan to tackle this.

 

3. Site Visit - We've not received any progress updated from builder after June but at the same time builder has collected their installment. So we all decided to visit the site together and check the progress. We'll intimate paramount about our visit in advance and ask for the necessary arrangement.

 

4. Forming a legal association [Paramount Floraville Resident] - So we can discuss such issue with builder through association instead of talking individually. I think we'll also ask from builder to provide us one representative (Key Senior Person) so our matter can discuss properly and have a harmonized solution.  

 

Action Items -

 

1. Ankur will provide the draft letter for visiting the site (sec -137) on 30th Dec 2012 @ 11:00 AM. Everyone has to send this letter by mail and speed post to paramount office.

2. As suggested by one resident as per 2010 guidelines legal association can be formed by the Flat owners. Ankur will also explore the possibility.

 

I would also request other member to post the update\opinion if I missed anything.

Most of us received the below letter from Paramount.

Dear Sir\ Mam,
 
Please refer our demand letter dated 30-11-2012 due to the erratic behaviour of the software some errors occurs in the said demand letter have been oserved. Kindly treat this demand letter as null and void.
 
After reconcilation of your account the revised demand letter is being sent shortly with the extension in the due date.

Hi amit/ manoj - I think they are making adjustments only for members who joined prior to sept 2010, thus some have received the letter below and some haven't. I just checked with the builder representative.

Did the representative tell you why those booking after Sep 2010 are not getting the corrigendum letter. I also booked post Sep 2010 and have not got the letter.

any idea what should be the plan of action. Believe this should also be within the collective bargain we are putting up with the builder. Any suggestion how to take up with the builder. Feel since all are members are paying there dues the builder should not be discriminating basis when the customer was onboarded. OR they should provide some logic. As I am going on 30th for site visit, plan to drop in to their office as well to check on this. Member who can also come, pls join me in representing this case.

The representative mentioned that members who joined initially faced issues with home loan disbursements as the project itself was pending some necessary approvals thus resulting in delayed funding & in-turn delayed payments to the builder. The letter dated 30/11/2012 did not take into account this rationale as the delayed payment occurred due to pending project approval rather than the member’s fault so penalizing the member with was unjust & rightly they have sent the revised letter, I think revision was primarily on the interest portion. However we need to seek re-confirmation on this & additionally we must seek answers to the below questions -
 
a) How is Sept 2010 or for that matter any date decided as a a cut-off ?
b) What implications the above has on the service-tax calculations, majority members got letter on 11/30 having a revised service tax calculation but then why this was not communicated to the members well in advance, at least I never got any communication on revised service-tax.
c) I joined in Mar 2011 and got construction updates only till June 2012 but nothing after that, why? The demand letters were promptly sent post June.
d) I did a site-visit 2 weeks back and I do not feel it is anywhere near finishing stage or definition of ‘finishing start’ requires clarity, current state looks like another 6-9 months wait period.
 
I joined this forum only 2 days back so I am not sure if you have already covered these points in your agenda item but will be great if we can have these covered.

Vikrant,

Thanks for bringing their rationale in light. Request you to join our meeting and be a active participant. 

We had a discussion on interest issue in the meeting. And our take is, for interest reason may vary for each of us but their interest component should be appearing in subsequent demand letter. Here builder tricked us to extort money from us.

Hi Kartik,

Thanks for your update and guidance which I am sure will be very handy in negotiating with the builder. I too had signed the agreement in April 2011. Whats surprising is the way the management is handling these issued. Initially they had said whatever interest shall accrue same will be demanded at the time of possession, then why they are asking the same at this stage. And that too without any logical calculation. Why aren't they transparent about it. Last thing a buyer wants is that such things are handled in a high handed and opaque manner as its the hard earned money of buyers that is involved. Moreover the bank is also not willing to finance the interest portion. Am planning the 30th Dec visit to try and sort out the matter and all aggrieved are requested to come and try to have a solution to this problem.

 We went to their office on the 25th as the interest component charged was not justified, to which their back -end In charge,Aashima could not give any satisfactory reply. Secondly, we inquired as to why the lifts were not installed, to which she replied that the lifts were ordered some 6 months back.
This seems to be  a cock and bull story, as no reputed company holds up an order for 6 months or more, unless the builder himself has asked them to delay installation, so that we cannot go and inspect the flats or their progress in finishing.

 This is  for the general information of all concerned.
