Anybody interested in joining me to know the doors of the court? I think its high time to do something rather than bargaining individually with Builder & paying something to settle the account. The point is Builder's demands are unjustified. Now its the question of ethics & lets not accept any lower amount offer from the Builder to individuals. Builder has to follow some fair practices in his dealings by either waiving off for everybody or charging everybody. Lets ensure that we are not becoming self centered by accepting close room one to one deals.

I feel that Mr. Ashwin Bhandary has made a valid point.
We need to  bring pressure on the Builder to provide some proof of progress inside  our flat,  as they are making unreasonable and unjustified demands.
Legal recourse should be our last resort, as we will be  playing into his hands, as that is what he wants, i.e. to buy time at our expense.
To many of us this delay of even 2 or 3 months is going to be a financial crunch as our EMI is starting from Dec2012, and some people are living on rent also.
We should get the builder to pay us an interest on 18% now for the delay, beyond the grace period, as he has set the ball rolling.
Also, we need to impress upon them that their staff is extremely rude, arrogant and unco-operative, so if they wish to collect honey( money ,in this case, from us) they cannot afford to kick the beehive.

Pls....take a decision as to whether we want to file a case against the builder or not.... I have neither forced or asked anyone to file a consumer case against the builder. I think its better to have some consensus amongst ourself first on the way forwad.

Regards
Ankur

Even I am not in favour of approaching court at this moment.

Lets wait for their next demand letter as earlier one now became null and void. If they continue with their un-justified interest component then we'll definitely take the necessary action.

I got revised letter from Paramount on 12.12.2012, but they are still showing same interest with no drop of interest till 30th Sep 2010. I guess we should start look around legal options to counter malicious action of the builder. I work in Pune but will work with this group for our common goal.

Thanks and regards,

Ranjan Sharma

Even if their current demand is showing interest then all should meet on Sunday and take the decision on next course of action.

Hi Ankur!
What is your expert opinion on this?
If we take this up in the Consumer Court, will the Builder be able to delay the possession?
Or shall we take possession first and then fight it out with the Builder over all the excess charges he is taking as many of our  friends have pointed out?
All the points mentioned are very valid, but what should be our first priority?
