Sec-2 Haldiram place is not having sufficient parking place. I would suggest to star city mail in mayor vihar ph-1. Its near to Metro station which is ideal for every one. Plenty of car parking space available and not crowded. It will be good if we also identify the agenda.

Hi Friends,

It would be a good idea to definitely have a meeting at this stage when we are not hard pressed for some deadline as it was last week. Though we may not have a meeting at Builders office, but can spend time among the group identifying the group leaders who have good competencies in the Finance/Taxation/legal  matters and who can lead the talks on behalf of the group with the builder at appropriate time on the issues faced by everyone.

If you find convenient, please make it a point to have a general meeting at Haldiram Sector 63 Noida at 2:00 PM. It may be a start for us to discuss the important matters for future course of action:

1. Actions/Requirements to form a legal entity of Paramount Floraville Residents Association
2. Discussion on Various resorts available in terms of legal/consumer court redressal on the issue of unjustified demand by the Builder
3. Identifying the competent resources (legal/taxation/financial transactions) available within the group to lead the whole action and support other group members on such complicated matters.

Few people among us have already confirmed their availability. Request rest of all to join in to make it a head start this Saturday.

Neeraj, I think it's a good idea to meet but I think last time few of member of was having concern regarding meeting location @ Sec -63. They've to cross both Delhi and Noida for this. So meeting some where in mid and near to Metro station will be a good option.

Hello Guys,
I had also met Paramount Group including their CFO on Saturday. At the outset, I was very disappointed by the rude and arrogant behaviour of all of them. Their CFO was bit patient, and I could only manage to meet him after waiting for almost 4 hours. Following is the outcome, pointed in accordance with charges imposed:
1) Balance: The balance was genuine, and I paid it. Although, I asked them to issue a letter saying that there is no due as on 15th Dec after paying this amount, but they didnt agree to this and didnt issue any letter. I couldnt understand why, and neither did they explain why they are not issuing this letter

2) Service Tax: The additional service tax being asked was explained to me, and they said they are just applying ST to 3% of total amount rather then 15%. This was in accordance with some government ST guidelines and all others present told me that this is justified ask. Therefore, I paid this as well. HOWEVER, they didnt give any letter or notification demanding this ask, which I am concerned about.

3) Interest: The interest was mostly due to delays from Builders part (like delay in providing documents, not sending demand letter etc..). They said, there is no interest on interest, and there wont be interest charged over interest later on as well. The interest is not compound as also mentioned in all the letter issued till date. Therefore, we can pay this later on before the possession date. They also said, due to rush they will not be able to discuss on this currently and adviced me to come at a later date to discuss the same. I didnt pay this amount and have decided to take legal route for this. Basis is that I feel they should have raised this point earlier. Also, all demand letters from them clearly mention "The above mentioned total due amount is inclusive of any previous outstandings".

Please advice what do you all advice. I will go as per advice from the forum of this group.

Can we initiate action owing to following reasons?
1) The Demand letter which is only source for us to know our outstanding and then making the payment states clearly that the amount in letter is total outstanding?
2) The demand letter is not received on time. I have proof in form of email exchange with them

2. Delay in completion of society
3. How the same is affecting our financial stability.
4. Issues of penalty clause in the Agreement on the part of the builder.
5. Ofcourse, issues with respect to unreasonable demand of  Interests.
6. Certificate evidencing payment of service tax with respect to each flat
7. demand of penalty from the builder
8.And all other issues which may come out

No access to the site is definitely a concern. While the builder finds it easy to hide behind "ensuring safety" of the visitors, there has to be a way to provide regular tower wise construction updates to the residents.

not sure if many of you know but the work  in different towers in subcontracted to different contractors.

I second you Ankur,

I believe its is misconception with many of our members that the forming an association is to fight against the builder. No, its more of protecting our interest. I think this step would force builder to bring in more transparency, clarity and reduce the chances if fleecing individual owners and robbing off their money.

With a strong association, we can even make builder move fast on the progress of the project rather slowing it down and can track the quality of construction with much more control. The truth is that being individual customers and divided, we do not hold any control over any of the issues which are of great concern to us as future residents.

Let us meet on this Sunday or the next to chart out a course of action in order to protect our interests.
 If we allow the builder to bully us now, they will do so for the next 3 years after possession as the Maintenance will be under them.
 We would need Mr. Ankur's presence definitely, as well as anyone who is a CA. or an expert on legal / taxation and other  related issues.
Please take a call as to what we need to do NOW and which Sunday will be convenient for all of us to meet.

We are still to have an answer from the builder on the final plan / no.of floors / FAR used as these question have never been answered since we had an agreement signed. I think this could be another issue for us to include in our To Do List.

Seems interest component is still on builder plate. So I think lets meet this weekend @convenient place (near to metro station) and sufficient parking space.

But i would request that most of the members mayattend this meeting...otherwise we guys have been discussing many things through e -mails, which eventually is not taking us forward in any sense except we becoming wiser day by day by hearing each other's views.
 
So guys, pls attend this meeting positively....... so that atleast most of us are on the same page.

I believe, we are meeting on 23/12/2012 (Sunday) to discuss future strategies and also to explore the possibility of forming an association of residents / allottees. Regarding the venue, what about Akshardham Temple, they have enough space for people and vehicles both. If it is convenient to all, let us meet there at 11 AM. 

 

By the way, last Sunday we were at the site and as expected could not inspect the interior work being done. However, the construction workers informed me that the tiling work is in progress (2nd floor) and they have instructions to prepare flats as per the booking dates. Don't know the truth.


Facing difficulty in posting topics in the google group, it says "some tags are not allowed".

Couple more issue which I believe hasn't been taken up so far:

All the demand letters showed that this amount is inclusive of any outstanding dues, which unfortunately did not had the interest amount. If those demand letters had contained that interest amount (if its legitimate), many of us would not had defaulted for their payments from next time onwards.

Secondly, when I made the booking I got the rate of 2692/sq ft. this was excluding park/road facing PLC and IFMS both charged at 50/sq ft each. When I got the allotment letter, they told me they have included both these amounts in my per sq. ft rate itself and discounted it further to 2781 (2692+50+50 - discount). The allotment letter showed "Amount to be paid at possesion+IFMS = 0% = Rs -1", (-1 because of that Rs 1 was overcharged in earlier installments due to round offs).
But now they are saying that you IFMS is independent of that and you have to pay it extra at possession. Is it same for anyone else, or is it just me fooled by them ?

Paramount has just taken tenders for Electricals panels for basements (on 15th Dec, 2012)  from Jakson, NEC, RST, Tricolite, Ad Lec, etc. these panels will get ready somewhere around Feb end, by then they ll be able to start electricity in respective towers. The work is going on a very slow pace.

I have discussed this issue (Charging interest from the time of booking for any late payment) with 2-3 of my friends, who are property consultants (Unicon, Investor Clinic etc). They are saying, any builder will do this, if they don't have money to complete the project.
 
Is this the reason for this.

We shud check the progress as it is very much possible the project will go on slow pace once money is collected fully. We are also not getting pics etc that we were getting earlier.

Interest demand is cheating, we shall be united while handling this piece. At no point, any one of us shud be agreeing to such payment. Builder will try to negotiate at the end by breaking the unity. Some people wud say, let's pay some amount and get rid of this nuisance.

We have been given demand notice without any justification. Complete lack of transparency and we shud fight for this.

About meeting place on Sunday, Akshardham is a right place but we don't have any thing to sit outside of the temple in group and discuss. If we'll enter into the temple then we aren't allowed to carry our mobile phone Since we don't know each other it will be difficult until some well known landmark are not defined. But it will be little restrictive. I think as Atin suggested earlier Stat City mall will be the best option in Mayur Vihar. It's very close to metro station and ample of parking space is available. 

I am fine with other alternative as well if other venue will be more suitable for all.
