Offer of Possession

Hello All,

I have recently got the letter of offer from builder. This offer of letter does not includes following

1. Completion certificate 

2. Compensation towards late offer for possession (not sure even if it is completed)

3. Builder has also included some interest on delayed payment.

I am going to discuss this matter with builder and thought to understand if anybody else has similar problems? 

Please suggest if anybody has already discussed this matter with builder.

welcome to the group. we all have the same problems. how much interest did you get charged?

builder is bullying all of us around.

my problem: they never asked for service tax in 2010 and 2011 in the demand letters, but whatever I paid, they took 2.57% service tax out of it.

Interest component are huge and I am still going through all papers.

 

Not only this. Builder is plainly refusing to show the completion certificate. It appears that one of the group met Managing Director and completion certificate is shown to them. Which is what they are referring now to everyone.

 

Do anyone out of us know if they really have completion certificate?

Correct. It was shown to a group of our respected representatives. Not getting to look at the CC is still ok compared to paying a hefty interest which makes no sense.

if we have to pay this hefty interest to calmy take the possession..then i seriosuly suggest we all come up with a plan B to get back at the builder after possession.

Hi Dheeraj,

I made 100% payments by December 2013 as they had notified that final construction work started in Sep'13. They had charged late payment penalty in Decemebr 2013 though none of the earlier demand letters mentioned the accummulation of interest. I have not paid any late payment amount. I am sure, when I will receive the possession letter, the late payment charge would resurface. And I have no plans to pay it. Will have to fight. Probably better, if no one pays the late penalty and fight it together.

Dear Rajeev and Fellow Residents,

I met paramount executive (Jyotsana)  and her supervisor (shikha singh) on these points. Here are outcomes of my discussion. 

1) I have been told by them that it is not a legal obligation to give completion certificate copy to residents. Moreover completion certificate copy is shown to GOR in the meeting between GOR and paramount management. I personally do not know anybody in GOR otherwise I would have taken their inputs. It was suggested that we can check with Noida Authority for CC..I have asked an email confirmation at the minimum and still waiting for the same to be fulfilled -:(..

2) Regarding the compensation for delay in completion , I have been told that it has been agreeing with GOR that Paramount will pay the penalty only to those residents who has made all payment timely( within 60 days of due date) on each requirement.

3) Regarding the interest payment, I have been told that I have to pay it as I have made payment late couple of times. That means resident needs to pay it. 

I could join you happily but I had to travel abroad. Sorry for not been able to join you in the meeting this time..

I am going to hold interest component and make rest of the payment so that we deal issues in isolations.. As commented by some members already we should consider legal opinion and please consider me in for that..

Hi Dheeraj,

Thanks for the information provided.
I wonder why the GOR become inactive and silent these days as this is the most critical time for negotiations with builder and builder is making stories around GORs only.

At least GOR can clear what info they have or what are the facts
