I believe grace period is getting over in March 2013 for few of us. Anyone has checked with builder regarding Possession and Penalty ? I feel builder is again going to play malicious this time, I heard as per their Allotment letter you are not entitled for penalty due to interest.  And I guess this is the case with almost everyone.

Yes Amit you are right. I have also discuss same with builder. They are saying project is delayed but you are not eligible for penlty becoz of late payments. I realy don't know what will happen ? Yes My grace period expires in March 2013, I have sent a letter by speed post today for construction status update and update on Possession.
 
Your contention is correct. As per alottment agreement, Penalty is payable by Paramount only to those allotees who have either not delayed  timely stage payments OR have paid up the interest due on delayed payments.
 
Clause 50 of the agreement is interesting. Paramount will call for execution of Sub lease cum sale deed with the Noida authority.(Here Stamp duty only is payable to NOIDA Authority) This can be even before the possession of the appartment. If not executed within 30 days of such call they can cancel the allotment and refund all money paid after deducting 15 % of the total cost of unit at their discretion.

 Hi Sanjeev

  • Which clause in the allotment letter  specifies this?
  • As far as I could see, I could not find any such clause, which says that we are not eligible for penalty.
  • Let us write to them asking them to pay the penalty as they are exceeding the grace period.
  • Since they have been quoting the allotment letter, let us also ask them to either hand over the flats as per allotment letters or start paying the penalty as we are under financial stress , thanks to their unprofessional and indefinite delay,
  • We are paying the full EMI , without getting any income tax benefit.

 Sent this letter to Paramount yesterday(Please. see the attachment).
Hope this will be helpful to all others, whose grace period expires in March 2013; we all need to send this letter to them as a final warning, before taking any legal action/ moving the Consumer Court.
 Discussed with one or two lawyers also. They said that they can prepare the draft for us, but since the company's official address in in UP, we need to get a lawyer who is practicing in UP, to send a letter/ legal notice on his letter head.

Even a defaulter who has paid interest for late payment can claim the promised penalty from the builder for delayed handover of the property. The builder cannot avail dual benefit, i.e. taking interest and not giving penalty. After all, the law of the land will prevail over any type of the contract, whatsoever it is.

 Hi All

I believe some of us have already paid the penal interest of 18% as well as the service tax, in which case the builder's argument becomes null and void.

Any way, the way it has been worded is very generic in nature and cannot be used as a blanket clause by them to avoid  paying the penalty. Please  check out  the link below

Now if we read point no. 2 in context of what the so called clause Paramount is referring to for denial of late possession penalty, it is clear that by taking interest from the buyer for late payment, the builder has quashed his own clause, as he cannot not claim compensation (read benefit in this case) both ways.

In my opinion this group is useless and worthless because we are not following the mandate. Earlier group mandant was not to pay last installment as finishing is not started yet and builder not allowing us to see the site nor post any photograph on site.
After that group mandate was not to pay interest and service tax.

I am sorry to say that we fail to follow above listed two mandate.
Either we follow the group mandate or dissolve the group and fight alone.
Actually we are helping builder by not following our own mandate.

Ajay, it's a self organized group and we can't force anyone to follow a certain path. I know people who had not paid either service tax or interest. They are sticking with the group decision. By looking into the current scenario we are going to take some legal action. To start with we'll send a formal notice through the lawyer. You can also join us.

Hope this group will serve everyone's interst.

 Could you find a lawyer who is practicing in UP?
 In any case , once we go to Consumer Court, it will be a one-o- one with the builder.
 But we need to find a genuine lawyer, who will be able to follow -up the case and strong enough to pressurize them into paying the penalty, like the case in Mumbai, where the judge made the builder pay @ Rs.2000/-  per day of delay.

I quite agree with Amit on this issue. Also by not paying when the demand letter is sent helps only the builder and not the consumer. For the law the penalty on the builder is larger when the money due has been paid and the builder is not moving in the direction of completing the project.

The fact is at this stage after having paid the entire money and also the penalty the legal recourse is only fight one on one not as a group in the consumer court. Also not sure how the sub lease will be executed because Paramount has not paid the money that was to be paid to Noida Authority.

I am sure the builder has some legal option when he has been refusing to let allotees enter and check the progress of the project inspite of receiving the entire money for the house. The builder has not been sending the pictures regarding the progress of the project and he manages not to speak to any of the allottes on their requests. No one is ever available and maybe they are deep financial crunch after buying more land and not in a position to complete the project. Paramount Symphony has also 1 year late with an additional tower on the green patch

 Let us not go by hearsay, alone, but INSIST that the builder should give us a commitment in writing as to when he intends to hand over possession/ registry  etc within a week, failing which, let us send him a legal notice  individually.
 If he chooses to ignore that, then the only option left with us is to take the matter to the Consumer court; in the case of Paramount Symphony also, I believe that there was a delay of one and half years.
 I have been talking to the head of Back end operations on a daily basis, for the last 2-3 days. and insisting on a written reply, as they are not going by the allotment letter, to which she has informed me that she is not authorized to  reply to us in writing. So I have asked them to send a reply from whoever is authorized to do so. as their AGM Projects, Ankita Sharma, never picks up the phone.
 In any case, let us start sending the legal notices by next week itself

 Hi All
 We had visited the site on 9th March,2013, where thy were hosting what they called the best Property Show in Noida , in conjunction with Magic Bricks and a host of other property dealers. Almost the entire marketing team from Paramount was there. Their entire focus seems to be to sell the remaining 270 flats at any cost,by offering the new buyers the scheme of  booking at only 15% and pay the rest on possession.
 When we asked to see the progress inside, they refused saying that  finishing is going on in the 14thand 15th floors, and there is a risk of casualty to visitors, hence they are not letting us go inside to see the flats. Also, that flooring is yet to be done.
 This just goes out to prove their lack of seriousness, because if they wanted to hand- over in Sept , they would have installed  at least on lift by now, and work would have been done round the clock.
But they are not transparent in their dealings, which we have learnt the hard way by believing in their false promises.
 This is causing  many of us financial as well as mental stress, as without getting possession, we cannot avail the income tax benefit, and the banks have already started charging the full EMI. So we seem to be losing the advantage of booking early in the soft launch.

Sending  a legal notice, and pursuing the case in a consumer court, requires proper documentation to enable the court give a favourable ruling in favour of the allotee.
 
One part of the documentation we posess:
 
a) Alotment letter
b) Payment receipts,
c) Letters to Paramount requesting status of completion and possession.
 
The other part we do not have, and this can be obtained through  filing of an RTI with NOIDA Authority requesting status update of the Paramount Floraville Project, land for which was allotted by  for a CGH project to Paramount under its aegis, and further approval by it, of the building plan with dates of likely completion mentioned.
 
I had suggested that Mr. Vishal file this RTI as his loan transfer was rejected by SBI citing lease payment plan pending with NOIDA. This will be accepted by NOIDA as a valid reason for filing of the RTI.

Under the RTI act, no reason is to be disclosed to the authority for filing of RTI applicatiion, any person can file it.

To start with I am not Mr Jagirdar but Ms Jagirdar. 

1.We all have been trying long enough individually to get a commitment from the builder on po cession though the fact is that its clearly visible that the progress is very slow and being realistic will be around the same time next year.

2. There is no commitment or discussion with the staff since they never let any discussion happen or will keep telling you that they are not allowed to discuss any any one sennior will never meet you.

3. All of us have made several attempts to go and see the progress of the project and also a group but have not been allowed entry citing safety reason. This is not the only project in construction where people would come and check on the progress. Did the communication with the builder help to get access to the project after paying complete money.

4. It is not hearsay when builder delay projects they are normally under financial crunch because they acquire additional land instead of completing one project. Paramount has huge unsold inventory in golf forestee in Greater Noida and Emotions in Noida extn where they had faced an issue of land clearence and projects were stopped. Trust its not hearsay and I work with Hindustan Times and have spoken to some people regarding the same.

5. What is more critical to find out is whether we can fight as a group in consumer court to exert pressure or we can only fight as individuals.

6. There is no current law or guideline to punish builders when they do not deliver on committed deadlines

 Sorry for the lapse.
 About hearsay, I was referring to the point made by Mr. Vishal, because, our loan is also from State Bank of Travancore, and as far as I know, they are very meticulous, regarding all these details.
 If SBI has indeed verified that Paramount is defaulting in payments, then Mr. Vishal can scan that letter and post it here , so that we can take it up with them.
 I agree to all your points that they are extremely high -handed in their dealings with old customers, as  by now they have taken 100% of the cost of the flat from us, so they do not need to talk to us or entertain us.
 So now they have left us with little option except to move the Consumer Court.
 Please refer to  my links   posted yesterday. where the apex courts have punished the builders who are delaying the projects and harassing innocent customers. So it is not that they can get away with murder, and that they are above the law.
 When I challenged them with the Allotment letter today, they were stuck to only one argument about penalty. so I told them that when they are not abiding by the Allotment letter, how can it be binding on us?
 They cannot have their cake and eat it too, by picking and choosing to follow the clauses that suit them.

 Right now the burning issue for us is to get the possession on time, say latest by Sept.2013.
 For that, the documents that you have mentioned seems to be sufficient. We can always check with a lawyer and take up the matter in the Consumer court.
 But regarding your other concerns, as I said, we shall need sufficient proof if we want to challenge them on those issues.

I don't know any lawyer. Also the large daily newspapers have limited space and they generally only cover stories of national interest or impact. This is a practice with all builder large or small and there is lack of any govt regulation on them since they find elections. Only small media house may just cover it but it will not give desired results

 I believe that  the flat buyers of Unitech, who were promised Possession this year, and not yet given the same. have called in the media, Star News, who have covered their grievances, and will be  aired on 18th of this month.
 Does anyone know someone from Star News? May be we can get them to cover our grievances too, that would really help our cause.

Anyone is having any update on Posession or Penalty? I guess earlier builder issued an letter to few, "they wil be handing over Posession soon....."

Hello guys,

I think ajay is right. We don't have any idea when we are going to get possession. No date is issued by builder for possession. I went to site one month ago and there are very few peoples are working on site. I don't think any work is going on there. So God know when we are going to get our flats ??????????????

Update about paramount and sector 137
 
1. Builder is using stones at boundary wall. It's a good thing require less mentinance and long lasting.
2. IGL has installed it's pits and pipelines across floraville boundary.
 3. Poles for street lighting has been installed in sector 137.
4. Today saw electric line installation work going on from authority till bridge near floraville.
5. Ground floor work is on the role. I believe on 31 December we will be able speculate the correct deadlines accurately.

On sunday I visited the site. Work is on progress but on low pace. what Mr. Muntazir summarized is the actual gr. Work but we must pressurized the builder to increase the pace to get the possession at the earliest.

 As per yesterday's newspaper, Noida and Greater Noida Authority are going to post latest updates about Builders, their sanctioned plans etc.
We also posted the reply from Noida Authority directing Paramount to display the  layout and sanctioned plan at the site, which they have not bothered to comply with. Please ask them when you meet someone in authority from Paramount, as to when they are intending to hand over possession.

I believe many of us have received the demand "On start of finishing" with due date on 20th Dec. Let's plan to meet and discuss if we should pay this to the builder, as he has already taken 90% and not given any concrete response on possession date.

Please understand the need for a united group to tackle this builder. Also just to caution, I hope we don't have a mole in this group. If so let's close and form a new group after meeting.

On Saturday I visited the site. The ground reality is it will take at least one year more. I am very much agree with Nandini opinion. I also called up the builder office one lady pickup the call and told me that they are issuing the possession letter in feb, but not ready to give any thing in writing. I know she is making a fake commitment like from past six to eight months. after all she paid for the same role.

As per your update we will get possession in 2015. I think till that time people will get possession in noida extension as well. But on that still we will get such type of update. You will possession after few months. I think we are stuck in deadlock. Anyone have idea how we can break this deadlock.

Dear All,

On my way to office I cross Paramount emotions project in Noida extn daily. There is no work happening on that project the entire labour from floraville has been shifted to green forestee in G Noida. The builder refuses to give any commitment in writing and banks are not doing anything. Its a deadlock where atleast in my case have paid 100% money as of June 2012 nd paying growing EMI and rent.

No builder gives you penalty before time of pocession, i anyone know of anything different please share. I have checked with HDFC since I have a home loan from them and was told that he will have to pay penalty at the time of poccession

I too visisted the site a week back and the same would take atleast one and a half year to complete.
I knw this is a problem for all of us since the builder is not sticking to its commitments as far as handing over of the possession is concerned. 
We can always take a legal recourse for the purposes of issuance of necesary directions for handing over of the possession.
 
On the other hand, I think most of the Projects in the locality in Sector 137 are going on a similar pace and some of them are even way behind the Paramount Project.

Even I have not received any such letter. latest they informed on possession was March 2013.

Yes we all need to meet and resolve.
Heard that the builder has put construction on hold because of RBI bank new rule.

I just shared what the branch manager of HDFC noida told me. Also a friend of mine booked at 100% cash down in Logix in 137 he was promised possession in June 2012 and has still not got it and is planning to sell off his apartment. Since he has been paying 100% EMI since beginning becoz of his plan resulting out of 100% payment.

I am one of those buyers who have not paid delayed payment penalty. Please let me know in case all of you are following the same. If most of you have paid, then I will also pay to avoid any inconvenient situation

the delayed payment penalty is something that is completely baseless and they never show any such delayed penalty accruing to your account in any of the demand letters which are the basis of your any payment. I have clearly mentioned it to the builder and have not paid anything what they call is 'delayed payment penalty'. So, you are in right track.

Hi,

Even I have the same view point. In any of my demand letters I was never told that there is a delayed payment penalty.
In all letters it was mentioned that there is no due.

In my case they have not mentioned anything in demand letter but they have mentiond this point in allotment letter which i have signed at the time of purchase. "In case of delay in payment the company will charge 18% interest p.a.
Any how now this is not vallid anymore as they have also delayed project.

Same is in my case. I have not paid the penalty yet. I asked them why it was not mentioned in demand letter and they had nothing to say but that I still would need to pay it. I paid the service tax but not paid the penalty.

They would ask for the penalty at the time of posession. It is mentioned in the allotment letter.

Yes they dont mention it in demand letter but if you would ask them via email to send your unit's "Interest Ledger", they will send it promptly and you will be able to see your interest due

I do not know whether it is mentioned in the allotment letter, but thanks Kapil for bringing this to our notice. The buyer will be paying as per the amount demanded in the demand letter. In the below portion of every demand letter, it is also mentioned that the amount due is inclusive of any previous outstanding balance and outstanding should mean principal+interest(i.e., penalty)+any other charges. If you have paid the due amount of the last demand letter, how they can claim for any penalty?

Interest will be calculated from the due date of payment vs date of payment recd. And that they can demand the same at the time of final payment / possession. They are getting a letter signed @ the time of full payment on a plain paper that you are ready to bear the interest charges for late payment enabling you to take possession.

Latest update. GM construction at floraville is about to resign. Paramount group is in financial crunch from last six months. Even the number of contractors has been reducing at very fast pace in this project. Reason payments has not been done for some time.
You guys can check there payment register if you have inside links.
Means builder has not intention to complete this project in even in 2014. There golf foreste project has been super flopped. So not getting money from that project also. And paramount emotions is in more worst situation.
So catch 22 situation has come up. I suspect we will not get it in even 2015 also.

         Please find the latest pics of 10th floor in Tower Blue Bell. We will not get the possession even in 2015 also if we do not act together.

We should ask the builder following things :
1. Possession dates in written, preferably in front of media. 
2. Every builder has ESCROW Account in banks for specific project, to which our DD or or white money went in to. ESCROW account has few terms that you can not take the money out of this account for any other project. So builder can not use your white money for any other project. Of course your black money can go any where. And amount of white money is also huge in this project as it was sold out early. I speculate, chances are that Doors, frames and other RAW material must have been purchased in the name of floraville but has been used in there golf foreste or some where else. Suggestions are required "How can we audit that ? Accountants in our group can help to enlighten the process".
