Got the Revised Interest Calculation letter

Hi All,

I have got a interest calculation letter from the Builder.

In the letter the builder has given the time of 10 days for the payment.

Please let me know if anyone of you has also got the letter like this?

I guess, interest ghost is out again so we should be ready with our next course of action.

Ankur, we need your help regarding forming a group (legal/formal/in-formal) so we can put pressure on builder.

if doesn't agree with us at all then as a last resort we can go ahead and file a complaint in consumer forum.

It is indeed heartening to see the effort you are putting in on safeguarding our combined interests.
 
However I can not help being concerned over a possible mass hysteria on this issue. There will be many genuine allottees who have paid their installments on time and hence  are not liable to pay interest, and they have to be safeguarded. 
 
However there will be definitely some who have defaulted on payments, are liable to pay interest, and will try to piggy back on this initiative.
 
How do we safeguard ourselves from this ? 
 
Are we giving Paramount an opportunity to delay the project which will adversely delay the possession date. We all have bank loans and  Pre- EMI's payable. The longer the possession delay more the interest payable to banks.
 
Proper EMI is only applicable on full disbursement of Loan, having both components of Principal repayment and Interest.
 
As suggested I had gone to Paramount  to take up my case as I had recieved an unjustified demand of Rs 2.5 lac as Interest. I have since received the revised demand letter for only service tax of Rs 6000 approx with the total interest waived, and shown as Zero payable. The service tax has since been paid.

Dear All,

I quite agree with Pummy. The important issue that all of us are facing and need a discussion with the builder is no access to the project to determine the progress. When I booked in Oct 10 I was told that I would see my apartment in Jan 13 and leave that alone not able to get into the complex.

Any kind of litigation will delay pocession and for most of us it would mean every increasing rent and EMI

It is interesting to know that entire amount of 2.5 lakh has been waived off.Can you please enlighten us how it has happened .Was the letter issued to you in error or you have been able to convince them about genuine reasons for delay.Kindly elaborate on this issue with all possible details like dates for which interest was levied.Hope you furnish complete info so that we too are able to get same waiver.

Sure I will share. It is for the good of all of us.

I had booked in Jan 2010 when the project was not approved for home loan.

In June 2010 Paramount had issued a general letter to all allottees that IDBI bank had approved the project and that we should submit documents for processing of loan and to avoid any interest charges.

(I can scan that letter and forward it.)

As I had already submitted my documents to IDBI in June 2010. The demand for interest was unjustified.

This argument backed by documentary evidence was accepted and interest charges waived

Hello Pummy,

I am vey happy to hear that your 2.5 lac interest became zero. I would like to congratulate you and I've no intention to delay the project. I 've also taken the loan and paid all my dues. I also desire to leave my house ASAP as you are.

Regarding the unjustified interest demand, reason may be vary for interest charges but deliberately they didn't mentioned in subsequent demand letter and now they are seeking that money. And they way they brought up this interst issue no wonder they will ask for same before giving NOC for possession.

You've seen progress of the project on 30the dec and we all know project is delay for more than a year. Now we've sufficient time to fight for this. We've already made our payment so why builder will delay? We've some disagreement with builder and we are fighting for this. So filing consumer complaint won't be causing any delay.

As far as my case is concern I've not received new letter yet and I also visited their office today but they failed to provide.

It's a time to show our unity so builder shouldn't think to mess with us. As I said we'll be filing case at a last resort. Hope I've clear your doubt.

Hi friends, 

I have been following this interesting discussion and agree to most of the viewpoints.

The builder is going to waive off the interest if he is caught off guard on any point and I believe that's what has happened in Pummy's case. We all members of this group are interested in the same... getting a waive off for non-called for / invalid / illogical interest charge. No body here denies to pay the Service Tax and even interest if it is calculated in a fair way based on actual ground realities and events timeline.

The bringing together of all of us under an umbrella is gonna strengthen our common cause and for that forming a legal group and association is the best possible way to go forward. The builder simply can not delay the project just because we have formed an association and are talking to him on a common platform.

Just an update, as per discussions among myself, Atin and Ankur Gupta, I visited the NOIDA authority today to  understand the possibility of forming an association, unfortunately NOIDA authority has weekly off on all Saturdays and Sundays. So we can get some info only next week once I try visiting there again.

guys I feel already December has passed. Penalty clock for builder has also started. But there is no communication on the delivery side of the project. Every body should write a letter to builder mentioning that we have revived the revised letter but still we feel that there are some miscalculations and would like to meet in person for clarification.
And they are not lifting the phone which I am tring from the last one week.
I belive wait and watch is the best policy since at the end I feel this amount can be knocked off against builders penalty amount. Further I am sure they ll come with some dirty game of super area and actual area claculation which I am sure will be on our end. To adjust these kind of amounts its better to hold this amount and ask for clarification.
Points which can be discussed are
1. Service tax calculations bedfore June 2010
2. They are charging intrest for each and every day. Why they charge payment on the delayed days which is on there side. for informing bank that is acknowledgement receipt to bank for the 20% part. In my case it is alwayes between 10 to 20 days.
3. In first demand letter there was no component of service tax which they setelled later by there own from our 20% part and there was always an outstanding throuh out the tenure which they intentionally told us later to get these charges.
Balance what ever days we have delayed payment can be adjuated against there penalty. So I feel let's clear the total out standing for the flat and service tax and hold this interest till the time possesion indication comes. Which we will subsequently settel against the penalty for the genuine intrest charge.
