Please refer my last mail Dt 14th June 2013 showing you the proof of mandatory requirement for registration being the OC (as per GO 168). Till date you have not replied to my above mail, and now you have sent a mail regarding payment of registration fees and that too without showing us the actual flat constructed by you. How can we proceed for registration without actually verifying the product and its specifications given by you. How can we register the property unless we are satisfied with your product for which we have invested our hard earned money. 

Also note that in the Tripartiate agreement with the Bank you have undertaken to execute and register the Sale Deed after the delivery of the Possession of the Falt/premises (Clause No 6). How can you then demand for registration without delivering the possession.

You have also mentioned in your mail that an amount of Rs 19275/- is outstanding for the consideration value (CV) of the flat. Please refer to our last meeting with you where you have provided me with a statement mentioning that against total CV in SAP Rs 45,23,572/-, the total Net payment received by you is  Rs 46,82,803/-, which means an excess of Rs 1,59,231. 

Even if you add the Interest liability of Rs 1,00,978/- as mentioned in your statement (copy attached) to which I do not accept because the sole reason for the delay in disbursal of payment from the bank was the delay in GHMC approval of the building, which was purely your responsibility, I should still get refund from you. 

However I insist that you pay me the total excess monies paid to you i.e Rs 1,59,231/- along with interest of 18% from the date I paid i.e 28th May 2012 (Your statement shows 31st May 2012) which work out to Total Rs 1,87,893/- (as on 28th may 2013).

I once again reiterate that I'm not going for registration unless and until you show me the flat/premises and I'm satisfied with it which should match the Specifications and amenities promised during the booking. Also you have to provide the OC as per the GO 168 before registration. I Should be refunded back the total excess monies paid to you and its interest as mentioned above.

Operational Guidelines:

 

·      Lodha will facilitate the franking of the Sale Deed with the Stamp Duty payment paid by you, for your convenience.

A.

Both the Applicant and the Co-Applicant(s) need to carry:-

1. Four Passport sized Photographs each.

3. Two photo copies of the PAN Card for each applicant.

4. Form 60 needs to be filled if PAN card is not available.

Special Cases

3. In case of an NRI customer, the POA should be authenticated in the country of residence of the NRI post which it needs to be notarised in Andhra Pradesh
