Dear All,
Despite of the known fact the GHMC approval is delayed for EDEN C 6th and 7th floor, SBI stoped my preapproved loan due to lack of document support (GHMC Approval) from Lodha builder. Once they received approval copy SBI disbursed the loan, Even lodha builder is aware of the fact still threating by the means of mail for interest.
 
Below tactise been utilising to threat and pull the money.(These type of tactise used 2-3 times)
 
Do we have any expert answer or solution? (Lawyers openion)
 
Since this issue is specefic to some target audiance who are not having GHMC approval and bank stoped the preapproved loan and builder is treating for interest.
 
We may draft and send the solution to the impacted customer and consider this issue.(Impacted customer may voice up)

We are pleased to share a limited period Happy Hours -  Interest Amnesty Offer, wherein you can avail up to 60% waiver of your outstanding interest which is currently chargeable against outstanding dues towards your consideration value.
 
Terms & conditions of the offer:
 
1.       In order to avail the offer, you need to clear all of the below dues on or before 31st August, 2013:
a.       All demanded but unpaid dues towards the consideration value
b.      All demanded but unpaid service tax
c.       50% of interest outstanding as on day of payment of (a), (b) and (d)
d.      100% outstanding interest on delayed service tax
2.       Additional 10% points waiver will be applicable over the 50% waiver if payment is made on or before 20th Aug, 2013.
3.       In case the cheque pick-up facility is utilized, then the applicable interest waiver will reduce by 10% points and 60% of interest outstanding as on day of payment of point 1 -(a), (b) and (d) will have to be paid
4.       This interest amnesty/waiver is for a limited period only and is a suo-moto gesture, at the sole discretion of the Lodha Group.
5.       The interest amnesty will only be offered on a complete payment and not a partial payment. No interest waiver will be applicable in case of partial payments
6.       This scheme does not apply to any interest already paid in the past and the same will not be waived off. The scheme only applies to the current dues outstanding towards your unit/residence.
7.       This amnesty/interest waiver is not applicable on interest charged on any kind of taxes.
 
Please note that both parties understand that timely payments and interest implications on any delays continue to be a purchaser’s obligation, since time is of the essence for your application/allotment letter/agreement for sale. If your payments are delayed for any reason and you miss the above mentioned date, this offer will have lapsed and 100% applicable interest will need to be paid along with the dues thereafter with interest from the actual due dates. I have also booked Eden C - 6th floor and got disbursement from SBI only in Feburary, 2013 after the GHMC approval was given. But, Lodha  asked me  to pay interest of nearly 6 lakhs. I refused and sent Lodha legal notice. they replied back saying, they are not at fault in anything and i simply have to pay up. I am not going to pay and i think, this is the decision of all the buyers who have been asked to shell down huge amounts of interest.

I have heard that the association has approached Consumer Court. i hope that will bring some solace to us. Whether you wish to send Legal Notice or not, kindly dont pay the interest. none of us are paying.
