Good work by all, really appreciated, and whats our main focus now, pls read below.

1. Registering for higher Price will follow further in registration because already few are registered. But yes we need to go and reach the District registration general. (As we cannot go the meeting in next 10 days can few can volunteer in approaching for the necessary officials representing our association/individuals). So that we can be updating in the next meeting on this as well.

2. As a step the following area our course of action to get done from them before registration :
           a. Not to accept the current sale deed. 
           b. No Payment for the Club house/or facilities moved out sided campus. We don't accept any facility out side campus.
           c. Site Visit.
           d. OC - for registration (We stand as mandatory, without which we shall not go forward)
           e. If they tell anything is standard, we stand this is our standard (We cannot agree any one-sided stands by builder).

Good quality
1. ROCA Model Bath Tub ;). (for kids ;) - size looks like that )

Quality to comment:
1. 2 star Window AC. (High consumption of Current- if we get charge COMMERCIAL, we end up pay high)
2. Low quality Rails in balcony and steps.
3. Unsafe compound wall (Front side)

Today I along with my wife visited the Panjagutta SR office. On approaching a senior person explaining that we wanted to know the Market value of the property in the Lodha- Casa Paradiso Project in Sanathnagar, he promptly replied that it is Rs 4100 per sft. I asked on what basis, to which he replied that the total Lodha property has applicable market rate of rs 4100/- per sft regardless of whether our flat is inside. On further prodding, he revealed that  the rate is due to the fact that the whole property is adjoining the Main Rd i.e Ameerpet tri temple to Fatehnagar bridge. 

I knew that this was coming and had with me the Form II (Market value Guidelines)and the key plan of the Casa Paradiso project with me along with me. When I showed the Key Plan to him showing that the residential Blocks are not abutting the aforementioned main rd he was a little bit shocked. I showed him that in between the Project location and the Main Rd (Ameerpet to Balanagar) there is railway property i.e the Fatehnagar railway station and the railway Line and hence the applicable market rate  should be Rs 2800/-  for the Erragada Bazaar to Fatehnagar Flyover locality. 

He then told me to represent the case to the District Registrar (near Erragadda Rythu Bazaar) and take clarification from him. He also hinted that it would be difficult because some flats are already being registered at  the Market Rate of Rs 4100/-. To this I replied that probably this happened because Lodha might have first registered the Proposed Club House at that rate since that location is abutting the aforementioned Main Rd. He said that it is possible. He was telling that even if a small part (as less as 5 feet) of the Total Land is abutting the Main Rd then the applicable market rate will be Rs 4100/-. He also told that if we approach the District Registrar then his office will go to the extent of finding out from old records if the if old property Bakelite Hylam had direct access to the Main Rd. In that case also the applicable rate will be Rs 4100/-.

I would request all to not hurry for registrations as per Lodha's "instructions". I would suggest lets us approach together the DR, probably through RTI application. After all, the difference in Stamp duty for Registration between the two applicable Market Rates  is approx. 1.5 to 2.5 Lacs depending upon  the type of the property. A satellite pic grab of Casa Paradiso Project is attached for reference.   

Those of who feel that there will be appreciation of property value, please consider that the appreciation of Property value will solely depend on the type of project Lodha finally gives to us will all the specifications and amenities. Remember nobody of us has seen the inside of the flats or the project. We do not whether there are any leakages or not in the construction. We still are in the dark about the electricity, Water, Sewerage connections. Only these along with the inside infrastructure/amenities will determine the actual appreciation of the property.

I had also been to lodha yesterday and I opine almost close to Dr Amber.  But there are a few other things that I would like you to note :-

  • First, it is very clear that it is their tactics to employ best pressure thru the possession process to get the flats registered as soon as possible to get their monies.
  • Second, atleast close to 15 or above people have got their flats registered to their risks.
  • Though they are saying it is fitout, but the project will be fit for living only after minimum 6months after possession thereon.  As per Akshay it takes minimum 6months, further, there are also some delays expected. That means people who are getting it registered are doing so at their own risk for living in a non-fit premise.
  • Further, they are unable to provide OC as on date, so how are these people getting it registered.  As per rules the GHMC does not give OC if the violations are gross and over and above tolerance of 5%.  
  • As regards, the registration rates prevailing, they have shown a document from R&S showing the value as Rs.4100=00 applicable. But Mr Akshay hinted that it can be pursued by our group with the R&S to bring it down to Rs.2600=00 or Rs.2800=00 as in the adjoining areas.  But then there are 2 dimensions it gives your property a validation of rates higher & beyond your purchase rates, which means anyone selling will be asking for rates for than 4100=00 psft which is good, by paying only a couple of lakhs more owing to difference in stamps rates for that amount.  ( But the good question is are there any buyers for those kind of rates ).  I personally feel this has been a manipulative move by LODHA authorities who must have bribed and canvassed to make it Rs.4100=00 (as obvious from Mr Akshay's saying that "you may approach R&S to bring down the rates in group", they must have employed same tactics thru bribing officials)  and above, so that they are getting bigger price for the remaining lot. Anyways, this needs to be discussed at a suitable meeting and there can be a possible remedy, if we think so, but at the hindsight a Rs.4100=00 on paper means appreciation of your property.
  • Further, the major CRUX of issues has to be put on the front - DEVIATIONS which is the hallmark of LODHA and their MANIPULATIONS, which needs to be fought legally.  Will appreciate feedback from our legal team / lawyer.
  • Another, major issue is there has been no mail / content saying anything on EC - Encumberance Certificate, please all of us be informed that LODHA avails a loan of over INR-60/70crores from SBI or SBH on this project, we need to have NOC and EC from them at the time of registration.  
  • Also, EC - needs to be obtained from them on other fronts like Municipal Taxes, Water Payments, Electricity Payments etc which are to be provided to us at the time of handing over. Otherwise, we will have to bear those charges and burden as well later on, they will pass it on to the burden of FMC and FMC will load it on us.
  • Finally, as you see the quality of Construction and the fixtures are seen from outside, it is a lack lustre structure from Lodha, boundary walls are so low raise any peeping tom can peep thru the 1st floor residents easily and even can jump and come over into compound.
  • Personally, i feel that Lodha has just give super structure, which would then have to be managed and done by the residents themselves.  
When are we having our meet finally, any decision on likely date. Update would be appreciated.

availability of material, labor, finance, etc.

- Anomalies about the saleable area ( this was brought to my notice by someone else at a later
time).

I am sure that the document contains numerous other objectionable clauses detrimental to our
cause.

The rate used for calculation of stamp duty is Rs 4100 per sft. Probably nothing can be done
about this, but I am not sure.

Such kind of secrecy surrounding the flats and paperwork is alarming. I request you to kindly
update the association members regarding further steps to be taken and schedule a meeting of
the association at the earliest.
