The price quoted by LODHA is for commercial property. I hope we have
not invested in a commercial property for residential purpose. This
needs to be clarified with LODHA. How can the charges for commercial
property be applicable for residential property.

hi all

whats going on? one mail says the RM tells you you have to register the flat without even seeing it once; another mail says Lodha is registering it as Commercial. the Value they are showing is atrocious.

Are we doing anything about these atrocities? i request the Secretary etc to convene a meeting asap to discuss the latest looting of Lodha. is there any action plan to make Lodha behave or are we just exchanging mails.

Please let us meet and take a decision on how to tackle them at this final juncture.

 Here is the Zoning regulation link and Master plan,
 
Page No 90 and 91, explained about Commerical property stretch from Mumbai Highway and Fathenagar.
 
 
 
I spoke with RM, they have converted this commecial to resedential property, but as per the master plan mentioned in the above link, the main raod comes under commercial.

Good effort, but when they have converted to Residential and if they give all as per MASTER PLAN, we shall register in the value they are demanding.

When they are giving as per the MASTER PLAN, we should not accept them.

Thats right Sir... we shall stand there with them..... How did a APPROVED RESIDENTIAL PROPERTY can be a COMMERCIAL REGISTRATION?

If this is registered as COMMERCIAL ... OUR Next LOSS List
1. TAXes are applicable as like commercial property.
2. Electricity cost is going to be at commercial rate
3. GAS will costed at Commercial at >1000 Rs or so....
4. WATER connection at commercial price... and much more.... :)

DANGEROUS on this registration....

MEMBERS -  we shall stand all together to close, till which no registration should be proceeded.

Question to be taken with the advocate:
" Lodha is insiting the buyers to register at the price higher than mentioned in the agreement"
 
 
Respose we expect from the lawyer to be sent to Lodha need to include something in the below lines
 
"My client -Casa Paradiso Welfare Association- would like to know why are you changing the rates than what has been mentioned while booking the payments.
This dual rate policy of yours shall be counted towards the compensation request causing any delays in the government approved possession procedure."
 
By the way... what is he charging per letter?

I've been interacting with RM asking about registration process; when I asked the sale deed draft, they said I can take my legal advisor to their office and have it reviewed and such insane responses. I have strictly denied going for registration until I get deed draft thru email or post, to which there is no response yet, as expected.
 
Association has been very helpful, especially for the candidated like me who are out station. Please keep us posted on further steps, what plans we have about sending them legal notice and when etc.

Also noticed that form-II, SI. No12 has two points.

One is from Erragadda bazar to Bharath nagar flyover which has the value 4600
One is from Erragadda bazar to Fathenagar flyover which has the value 2800

Aren't we come under 2nd point here?

Hello All,

Did anyone checked with the registrar office on registering our property at commercial rate ??

As rightly pointed out, the problem does not ends here as it is going to pinch us all every month because of higher electricity cost, water cost, gas, etc.. and not to forget the maintanence .

My humble request to our association to find out alternatives on this issue. What does our lawyer says on this. Can he help us in this issue.

If we do not accept the Sale Deed or any other document that Lodha is forcing on us, we should draft our own version of the said document that we think is appropriate and send it to Lodha that this is what we will accept. Use the lawyer to draft an appropriate document, review it with the members and send it to Lodha.

We can keep saying No to what they propose, or a better response would No we will not accept your document, but here is what we are willing to accept.

Dear All,
Whenever an industrial plot or an agricultural land is bought and converted to a residential area / Non Agriculture area the builder has to take the necessary approvals from the concerned municipality. Only after getting such approval can he start any project. This is an universal law across India and needs to be discussed with our legal advisors.
 
In case of the club house shifted outside is LODHA willing to give the undivided share of land of the club house as well to the flat owners.
First of all we should not agree to this and get back the compensation as suggested by the association.
