There seems to be a stark political contrast in state environmental policies between NY & PA, and more Pennsylvania residents are becoming increasingly outraged as gas drilling progresses. As the new administration appoints former industry reps to key advisory positions, grassroots organizations organize a state wide move to take control over municipalities in upcoming local elections. As real estate values plummet and incidents of ground water contamination rise due to spills and illegal dumping and discharge of wastewater, will local politicians listen and take precautionary action, or suffer the dire consequences? Time will tell....

Pennsylvania:
"Gas drilling will have many impacts: "...I am trained in environmental and public health science and risk management. I now live in Pittsburgh, an epicenter of ongoing Marcellus Shale industrial operations, and wish to share lessons I have learned from gas fields..." " (Letter to editor, The Daily Star) (NY)- http://thedailystar.com/opinion/x879866926/Letters-to-the-editor-Jan-4-2011

"LETTER: Do we want this here?: "...Two years ago, when I was in Wyoming County, it was still bucolic, a throwback to times past. We were in the valley of the Susquehanna River, with rolling farmlands, hardwood forests and small town communities that dated back to pre-Revolutionary times...The change I saw when I went back was monumental. I never saw anything like it. Tens of thousands of acres had been leased...First, there were the drilling platforms. These behemoths were interspersed throughout the countryside. They were well lit at night, and could be seen for miles. The platforms were built on 15-acre pads and looked surreal, especially since they were situated in the middle of cornfields. Then there were the trucks, sprawled all over back country roads. These were water trucks, 18-wheelers, and they operate day and night. Everywhere I went I saw them...Now some locals are waking up. They see what is going on around them. Many sense that their way of life is changing, and that they made a "deal with the devil." But there is no going back. It is too late. They are stuck with an ecological nightmare of epic proportions right in their own back yard. Even now, values on the sale of leased land are plummeting. Who wants to buy land encumbered by gas company leases that will last for many years?..." "Region can’t afford to lose drilling battle: "...Most people do not begin to understand the effects that thousands of wells being hydrofractured will have upon the rural character of the state. And the economic costs to this state will be huge..." " (Letter to editor, Auburn Pub) (NY)- http://auburnpub.com/news/opinion/mailbag/article_c8f775d8-17a7-11e0-acd1-001cc4c03286.html

"Bill Balyszak: China wants in on drilling game: "...And now China National Offshore Oil Co., a powerful state-owned company, is spending $2.2 billion for U.S. shale acreage owned by Chesapeake, the Nov. 6 Barron’s reports. If China can’t buy the business, it buys the underlying commodity. And if it’s their commodity, they’ll get it out of the ground the cheapest fracking way possible — damn the owners’ or neighbors’ health or other concerns..." (Events) "Gas compressor station proposed in Cecil: "...CECIL – It’s been a little less than a year since Cecil Township became the first community in Washington County to approve an oil and gas drilling ordinance, and the issue remains on the front burner there. On Jan. 17, Cecil’s zoning hearing board will listen to a proposal from representatives of Denver-based MarkWest Energy to build a natural gas compressor station off State Route 980. Compressor stations are typically used to filter out other elements from natural gas after it is drilled, put the gas in a pipeline and move it to the marketplace...Next month, Cecil’s board of supervisors will consider an ordinance that would restrict compressor stations to the parts of the township zoned for industrial use. A public hearing is set for 5:30 p.m. Feb. 7..." "State faces tipping point in new year: "...As the ball drops on a brand new year, Pennsylvania finds itself facing a grim environmental tipping point. Residents of the state concerned about our outdoors heritage, our woods and waters, our drinking water, and our overall quality of life should cast a cautious, fearful eye toward what lies ahead..." "Pa. Allows Frack Water Dumping: "...However, Paul Ziemkiewicz said the problem may not be so much what drillers are pumping into the earth; instead, he is concerned about what is flowing back out of the ground. "We need to be paying as much attention to what comes back up out of the ground as we are to what is going down in the ground," said Ziemkiewicz, director of the West Virginia Water Research Institute at West Virginia University. "There are salts coming back up in fairly high quantities." An Associated Press study shows this wastewater can be polluted with metals such as barium and strontium..." "There's no excuse: "...Just because it is inexcusable, and we will continue to stress that term, doesn't mean it should come as a surprise in this dollar-sign-blind Marcellus Shale tract. Just because it is beyond comprehension that such activity occurred with little regulation - state officials were caught flat-footed, according to the Associated Press story - doesn't mean it can't happen here..." "Water woes concern locals: "..."Actually, I have been complaining about the lack of oversight in the wastewater treatment problem involved in the Marcellus drilling that has been going on since the inception of this industry starting over seven years ago in Pennsylvania," Dr. Thomas Jiunta, president of the GDAC, said in an e-mail after reading the story. Jiunta said there should be a moratorium on natural gas drilling in the state until there is a reliable system in place that would require drillers to provide verifiable tracking data for each gallon of flowback water as well as each gallon of fresh water withdrawn from area resources for drilling purposes. The moratorium should be lifted only after an environmental impact study can be done on what will happen when treated water is released into an ecosystem, Jiunta said. "Until this is instituted, then Pennsylvanians cannot be assured that they are drinking clean, healthy water. This is guaranteed under our state constitution," he said..." "Pa. official defends rules on gas drilling waste: "...John Hanger, the outgoing secretary of Pennsylvania's Department of Environmental Protection, said he believes the new regulations are adequate to protect water supplies. "The drinking water at the tap in Pennsylvania is safe. It has not been contaminated by drilling," he said. The state set new standards in August governing discharges by any new drilling waste treatment plants, but allowed existing operations to continue putting partially treated wastewater into rivers and streams, as long as the water body's quality does not fall below federal drinking water standards..." "DEP chief: AP story on gas drilling wastewater misleading: "...Hanger urged incoming Gov. "Gas drilling focus is on credibility: "...Somebody is telling fibs about the impact of the gas drilling avalanche sweeping across Pennsylvania. According to the gas industry's lobbying and public relations machines, I am one of those who has been untruthful. In April, Rolf Hanson, director of the Pennsylvania arm of the American Petroleum Institute, the oil and gas industry's big lobbying outfit, accused me of being "fact-deficient" when I suggested in a March 28 column that the drilling might harm state forests and waterways..." "Gas Drillers in PA Are Getting Away With Dumping Chemicals into Drinking Water Supplies: "...The AP found more than a few reasons to be concerned by their research in PA, too. While the state seems to think they have proper safeguards in place they really can’t be sure. "Of the roughly 6 million barrels of well liquids produced in a 12-month period examined by The AP, the state couldn't account for the disposal method for 1.28 million barrels, about a fifth of the total, because of a weakness in its reporting system and incomplete filings by some energy companies," the AP reports...." "Michigan Supreme Court rules that citizens have the right to sue state agencies for issuing permits, and that diverting contaminated water from one river to another is unlawful: "...The case presented the Michigan Supreme Court with several fundamental legal issues. The first two issues concern the ability of citizens to sue under the Michigan Environmental Protection Act (MEPA), which expressly provides that "any person" may bring a court action for "the protection of the air, water, and other natural resources and the public trust in these resources from pollution, impairment, or destruction." (MCL 324.1701) Citizens and environmental groups historically had used MEPA to bring suit against private parties for their pollution and against state agencies when they allow such pollution by granting permits. However, the ability of citizens to enforce MEPA in the courts and against the state was limited by several Supreme Court decisions in the past decade..." "New legislative session starts, lawmakers take oath: "...Outside anti-Marcellus Shale gas drilling activists have set up protest signs and are handing out leaflets calling for a drilling moratorium. A giant inflatable Liberty Bell carries a sign against so-called "forced pooling" that activists say would infringe on property rights by requiring landowners to go along with shale drilling if their property is located in a drilling area. A sign on activist Gene Stilp's famous "pink pig" school bus parked outside the Capitol rails against "Tom Corporate" for the incoming governor resistance to a shale tax while his campaign was supported to the tune of $1 million by gas companies. Activists say the water supply is being threatened by the hydrofracking activity used to reach the gas deep below the surface. "They use 8 million gallons of water to frack," said Susan Norris, of Gas Truth-PA. "Why aren't they planning now? Nothing is going to happen until we are pushed to the edge of a cliff." After the ceremonies, lawmakers throw parties throughout the Capitol. In the House, private funds totaling about $23,000 are being raised to cover the cost of today's events. In the Senate some events are being paid for with public dollars but not all. Senate Majority leader Dominic Pileggi's spokesman alerts Commonwealth Confidential that the Delaware County Republican's reception costs will be paid for with campaign funds..." "Wayne Township Supervisors field residents’ complaints on variety of issues: "...Some residents also jumped on a proposal forwarded by Bobby Maguire, for the Guardian Co. to locate a lathing operation on Maguire property adjacent to the landfill on Fritz Lane to serve the natural gas drilling industry by creating a pipe yard and machine threading operation. Again, the concerns here were about heavy truck traffic, although board members pointed out that the region was already a heavily used commercial and industrial nexus. The audience also took exception to Maguire's next tentative proposal, which would move a small warehouse operation from one part of the township to another, but in closer proximity to a church. Citizens felt that the new facility would have a negative impact on the complexion of the community. In support of some of those efforts, Clinton County Economic Partnership President and CEO Mike Flanagan noted that some 250 local jobs have already been created by the burgeoning Marcellus Shale natural gas drilling industry..." "Gas Drilling Critics Say Corbett Will Endanger Property Rights With Forced Pooling: "...The hold-out property owner would be compensated for the gas taken from their land, but would not be able to prevent the gas from being extracted. Gene Stilp, a local political activist who organized Tuesday's protest, said the legalization of forced pooling would be a violation of constitutionally guaranteed property rights. "Sure, they'll give you something for it, some kind of monetary compensation, but the idea here is that it is a diminution of our constitutional rights to property," said Mr. Stilp. State regulators tightened the rules this year for any new water treatment plants, but allowed any existing operations to continue discharging water into rivers.
