Using special character '&' in search term

Hi,

I am trying to do a search term, which includes '&' sign. For example
M&M.

I am using the otter api, I find that the service is not able to
understand the '&' term. more ever its cause an error in the search
term.
I am using encoded characters of course.
For example the URL
http://otter.topsy.com/search.json?q=M%26M&page=1&perpage=100&mintime=1335484800&maxtime=1335707963&order=influence&allow_lang=en

in the response i can see that the system identified the URI as
"url": "http://otter.topsy.com/search.json?
allow_lang=en&maxtime=1335707963&mintime=1335484800&order=influence&page=1&perpage=100&q=M"

Is there any way to use & symbol?
Is this a bug?

PS - In the TOPSY main we page a search for M&M seems to work, though
with out the '&'...
