Please refer the following mail trail from the AC group to Orris.
If you have been following the conversations in the past, you would be aware of the irregularities and malpractices being committed by Orris.
 
While this has further been actentuated with the handing over of the Carnation apartments, Orris will behave the same way with AC and ACP owners too.
One sided BBA to start with, extremely biased handover agreement given to Carnation which absolves Orris and its management of all wrong doings, 10% and more super area increase without any carpet area change and no supporting documents, no payment by Orris for delay in handover citing labour and other farce issues, asking for "electricity charges" separately, not refunding EDC/IDC which has not been paid to government but has been with them for so many months now...the list is quite long!
 
You have already been a part of some of the communications I/we have had with their management on emails, phone and physical meetings. In addition some of the problems with ACP:
-Club issue which we raised wherein ACP members were promised exclusive club and now this is clubbed with AC. While I had sent them enough evidence to support this (including their own new letter which states the same) the reply from the management is out right rubbish. I hope you have seen the size of the club house on the site and on drawings. There are 250 ACP dwellings and another 750 AC. So if the club house was originally desinged for 250 and now should suffice 1000, just imagine the chaos
-The structure work has not progressed since the last 6-8 months. I am sure neither of you would have received any further demand. Not to say 80% or more of money is already gone. I have been to the site now a couple of times in the past few months and everytime there are few labours generally sitting around. With 80% money in the kitty, Orris does not seem to be interested in completing the job on time.
-The project team executing the project is doing a shoddy work. The kitchen specifications are not being met (issue of Double bowl sink you already are aware of. Imagine a customer has to visit the job site, find out the specs are wrong and then get them corrected. Is this really how construction is happening? Imagine what else they would have done wrong!). In carnation I saw the kitchen tiles colour combination-it seems some 3 year old kid was given the job to plan the colour combination of tiles in the kitchen, such a disaster.
-The "Green area" is a big fraud, please take some time to visit the site (if you havent). The towers are so close to each other and Orris has only kep the bare minimum distance as required by law. Hence Green PLC is clearly illegal
 
The rates of the property are really down in this part of Gurgaon and the delay and shoddy work will not help. So even if some of you are investors, it will not help in getting a good value in resale. The transfer rates have been abnormally revised (if you are not already aware of this), so even if you want to resell, there is a huge impact and Orris makes money.
 
Carnation and AC group members have decided to take this fight against glaring irregularities by Orris to the next level by spreading the wrong doings on the social network and taking help from Media. I belive all of us from ACP should fully support them in this endeavour.
 
Hence I urge all of us to be present for the meeting on 8th Nov 2014 at 11:00 am for a meeting with Orris MD/management in the office on the MG road.
 
Our ACP group has not got enough traction till now. If we dont support this fight, this will soon come to us as well and we will be too small as a group to be heard individually.
 
Request all of you to confirm on this email trail your participation so that we can get an idea of the numbers who will be present.
It will also be a good opportunity for all of us from ACP to meet once again and share updates.

1. Please refer to our long outstanding issues and the meeting last Saturday (11th Oct 2014) at your office between the representatives of unit owners in Aster Court and Carnation Residency projects and yourself.
2. Unit holders have been raising some gross irregularities in the conduct and practices of your firm with a request for suitable solution to the same. However, your response during the last meeting (on 11th Oct 2014) has now established that even as you and your staff had been promising suitable resolution all this while, you always intended to misuse the investors’ money and deprive them of their rightful dues.
3. It has been established on numerous occasions that the construction work at your site had been held up time and again due to your inability to pay your suppliers and contractors. This was verified both your staff and the workers/contractors. Your inability to perform your duties has led to delay in the construction and thus delay in completion of the project. Even while you have agreed to the delay, now you seem to be taking excuse of the government instruction to not use ground water as the cause of delay. This is malicious and ill intended with the aim to financially harm the unit holders in your projects.
4. You have levied extra charges on your unit holders by making false promises of giving them preferential treatment by offering green facing apartments. The fact is that there is no preferential treatment in the said units and the space between the towers is the bare minimum allowed between the towers. Even you and your Senior Management members have admitted that these charges (called ‘Green Preferential Location Charges’) are unilateral (from your end) and unjustified. Repeated requests by your unit holders to refund these illegal charges have not been heard. You have thereby used your position and cheated the unit buyers of their money.
5. Government had reduced the EDC/IDC charges long back( more than 3 years back ), but you continue to hold the excess money collected on Government’s behalf from your customers. This has not been refunded inspite of repeated pleas and requests by unit holders of your project. You have used your position to collect money on behalf of the government to illegally hold the money and put to your Company’s use. This amounts to financial fraud as you have breached trust of both the Government of the State and your unit holders.
6. You have made your customers sign a one sided BBA (builder buyer agreement). There are numerous clauses that go on to prove that the document is heavily biased in your Company’s favour. An example is that even you have mentioned a delayed compensation of Rs. 5/- per sqft per month which(Rs 5X12 months) is less than 2% of the cost paid by the unit holders(annual rate). The rate promised by you in neither close to the prevailing interest rates nor anywhere identical to the current rental rates for similar property in the vicinity of the said projects.
7. You are requested to look into these gross irregularities in your practices and carry out remedial actions so that you do not exploit the unit holders of your above stated residential projects.

Dear ACP Group, I think we have had enough of nonsense from the Orris Management and should take up the case with the Mr. Venkaiyah Naidu ,Union Urban Development Minister. Also a case should be filed in consumer courts to claim the interest on late delivery and the matter of 10% increase in the Super Area should be taken up. We must give a dharna outside their office and call the press to highlight the issue. This should be planned and done at the earliest. regards, jaspal singh gujral

Hi Everyone,

I fully support all the points mentioned in the mail trail. In fact, some of you might know from news or live telecast or a video that I am sharing, to bring everyone's attention to the point of 'Super Area' which is highly controversial and unresolved. However, there are instances mentioned, where court has asked the builder to produce the 'Super Area' calculations used to measure.


In another video covering the NOC from Builder for any transfer fee levied is not mandatory as per the ruling of the government: http://sites.ndtv.com/property/can-a-builder-charge-transfer-fee/ (First 3-4 mins. of the video, rest talks more about the tenants related issue)

Has there been any progress on Aster Court Premier hand over ? The project is delayed for over a year now and we don't seem to have any communication from the builder ?

We should all group together and ask for compensation for the delay. There are lot of cases where decisions are being made against the builders for taking the owners for a ride.

I booked in ACP in 2011 September and the possession was to be handed over I September 14.
Running pillar to post but of no use... Orriss is not ready to hear anything or refused. 
Have contacted my friend who is advocate in Supreme Court.  He has advised to immediately file case in National Consumer Court. He says that the bigger the group the better
