Odisha Govt. Circular for Enumeration of Homesteadless Families and formation of Inter-Ministerial Committee for the amendment of OSATIP regulation 2, 1956

Dear Friends,

Please find attached the two Circular of Govt. of Odisha;

1. GoR of Revenue Dept relating to Enumeration of Homestead less Families in diffrent districts; and

2. GoR for formation of Inter-Ministerail Commitee for the amendment of OSATIP,(Regulation 2) 1956

In case of the first GoR, Govt. Odisha has directed all the District Collectors to enumerate the number of Homesteadless families in their respective districts based the revised annual income(from 24,000 to 40,000) taken on 1st June 2015  by Govt for the Homesteadless family.

Howver, the targets set by the Govt. i.e Enumeration of the Homesteadless familes by 10th August, 2015, identification of leasable land and setttlement of 10 decimal of land against the eligible familie by 31st October are ilogical. 

While the set tagets can be  possitively seen so as to expidiate the land settlemnt process, The target has to be long term one. Besides, to fix the limit of annaul income of 40,000 for families would be a taugh task for the purpose.In the days of soaring price rise of basic commodities, this annaul income limit should be raised at least up to one lakh. 

The other important land rights issue is that  in the tribal areas land settlemnt should not be limited to Homestead /10 decimal only. While on an average 50 to 80 percent of the total lands of the tribal districts are recorded as government land and most of them are recorded as Abada Ajogya Anabadi(uncultivalbe waste land which is legally considered as un-leasable land), Govt.of Odisha has to convert them into leasable land and should settle them against the legally landless familyes having less than 1 to 4.5 acres of patta land for agriculature purposes. 

In the second circular, it is quiet evident that despite rejection from the President of India for two times to amend the OSATIP, Regulation 2, 1956, duly made stringent in 2002 which totaly ban the trasfer of patta land of Tribals to non tribal in the Scheduled 5th areas, the Govt. of Odisha is determined to sell them to non tribal.

Odisha govt. revises income ceiling for homestead-less families

: The Odisha government, which has revised the annual income ceiling from Rs. 24,000 to Rs. 40,000 for definition of homestead-less families, has started the process of enumerating the number of persons, who do not have land for constructing houses.

With the increase in annual income ceiling, it is expected that more families would be eligible for allotment of land for homestead land in rural areas.

“As the State government attaches high priority to shelter, it is imperative to go for further survey to identify the total number of homestead-less families in rural areas who would be eligible for allotment of homestead land.

The survey should be taken up through the tehsildars and completed by August 10,” Revenue and Disaster Management department directed issuing a notification

“The tehsildars and sub-collectors will be responsible to do verification of the eligibility in 100 per cent cases. The additional district magistrate will test check the survey work. Collectors may do some test check in a few cases,” the notification says.

Along with the survey and enumeration of eligible homestead-less families, a survey may also be undertaken to identify leasable and non-objectionable government and for settlement for homestead purpose, it maintains.

According to the notification, subject to availability of leasable and non-objectionable government land, eligible homestead-less families will be provided up to maximum 10 decimals in rural areas under the relevant provisions of Odisha Government Land Settlement Rules, 1983 and Odisha Prevention of Land Encroachment Act, 1972.

The department has set a deadline of October 31 to complete the exercise.
