Thanks Bidyut Bhai for posting the Guidelines for Rozgar Divas and Narayan Bhai for posting an Odia translation of the same. To the best of my Knowledge Odisha is among the first few states to have initiated the observation of Rozgar Divas (Andhra Pradesh had notified it late last year).
Interestingly the Rozgar Divas in Odisha comes at a time when the new MGNREGA Guidelines drawn up by the MORD has diluted the provision relating to Rozgar Divas. In the first three operational guidelines – NREGA Operational Guidelines (March 2006); 2nd Revised Guidelines (November 2006); and 3rd Revised Guidelines (May 2008) – Rozgar Divas or Employment Guarantee Day was recommended to be held once a week. In the latest guidelines (February 2013) the frequency of Rozgar Divas has been reduced to once per month. The clause stating “The proceedings of ‘employment guarantee day’ should be held in an open public space, with ample provision for proactive disclosure of information (including muster rolls, employment lists, unemployment allowance lists, etc.).” which was there in the first three guidelines, has been removed in the latest guidelines. Given this, the role of Civil society in helping job-seekers under MGNREGS to apply for employment and demand transparency and pro-active disclosure through the Rozgar Divas process becomes even more significant.
During my visits to different parts of the state, I have typically found that those responsible for implementing MGNREGS blame the low realisations to the lack of demand for employment while on the other hand in almost all cases in my interactions with the workers, they cited the lack of work as the key reason for not being able to work. The role of the PO (BDO)is indeed to provide work to those who demand for the same and to prevent any bogus work in locations where there is no genuine demand for work. A well performing BDO is not necessarily the one who has spent the maximum money. It is the one who has provided employment to everyone who wanted to work and prevented ghost works showing workers who actually have not worked. Till now the lack of adequate systems to receive demand applications and provide dated and signed receipts has made it impossible to really evaluate the performance of MGNREGS from this parameter. If the civil society activists (MGNREGA Catalysts)are able to ensure that everyone seeking employment are able to apply for work (for at least 14 days at a time but for which the application would be invalid for the purpose of seeking unemployment allowance in case of denial of work) and receive dated receipts, it’d make it possible to ascertain if there is real demand for work. Proper recording of such demand will ensure that we are able to have a formal record of whether in a particular Gram Panchayat / Block / District those seeking employment are able to obtain the same or not.
Civil society MGNREGA Catalysts can contribute to the process by:
1. Identifying and encouraging Job Seekers to come to the Rozgar divas to apply for work
2. Helping the Job Seekers to fill in the C1 form properly.
3. Making the job-seeker aware that she/he should demand and collect a dated and signed receipt for the C1 form submitted.
4. As the current C1 form does not provide details of number of days of work demanded, names of the applicants and so on, the job-seeker should keep a record of these details in another sheet of paper. MGNREGA Catalysts could maintain a record of these details on a separate register.
5. From the 2nd Rozgar Divas (19th June) onwards, MGNREGA Catalysts can discuss with job-seekers to ascertain if they have been provided work (through notices on C2 forms). In case they find any jobseeker who has not been assigned work, they can help them to seek redressal through the official grievance redressal mechanism established by the Panchayati Raj Department.
I am sure MGNREGS Catalysts seeking to help job-seekers to fill up applications and obtain proper receipts will receive all cooperation from the GP Level Officials entrusted with holding Rozgar Divas. They’d in fact be helping the GP Level officials through their work. Hope Rozgar Divas receives extensive support on the ground from the Civil Society Activists (MGNREGA Catalysts) across the state, especially in the regions where low wage rates and lack of local employment are forcing poor people to migrate outside Odisha under distress conditions.
