Deaqr Sri Prabhu, 

My wife and self are Senior citizens and are living on the income from the lease amount from our small flat in Saki Naka .

We and the tenant are harassed for several years and my attempts with Dy Registrar is elusive in spite of several letters and visits.

1 . Why NOC for Leasing of flats when it has been axed for the purchase of a flat ? :

I have been wondering why NOC for leasing out a flat is required when the mandatory police verification is already in force.

2 . Harassment from Managing Committee and Dy Registrar not doing anything in spite of several visits and letters :

society in has been punishing members for not taking NOC unless they give them a donation in lieu of the scaling down of the Non Occupancy Charges for leasing flats to 10 % of Service charges which they were erroneously charging at 100 % Maintenance charges.from 1998 to 202 which has ballooned to Rs 55,000 outstanding with 21 % interest which I am refusing to pay as it is a false claim.

I have asked them to produce a certificate from the auditor that the dues are towards NOCat 10 % of service charges as per Govt Order which they are unable to provide. They are saying you get a letter from Dy Registrar that this claim is illegal and they will write it off.

I am in a fix. Pl let me have your advice. They have disconnected intercom to my tenant for the past three years.

They are negotiating with brokers who are also members of the society and make them responsible to get the donation to increase the income of the society . I strongly objected and declared that MC has no business to demand donation from the tenant or the member and Non Occupancy Charge is the only amount to be given.

Differentiating parking charges between member and tenants :
In our society, the tenants are forced to pay twice the parking charges as compared to members. 

I argued that that as per bye law 3, definition of flat includes garages and parking in the open.Hence NOC is taking care of every thing and the society is not doing any extra for the tenant to demand double the parking charges.

Shall be pleased if you can suggest suitable action and the deficiencies in my actions taken so far.
