MUMBAI: What the high court proposes, the high court also disposes of. Holding a completely opposite view, a division bench of the Bombay HC has virtually overturned the ruling given by a fellow judge last week.
Justice S C Dharmadhikari had ruled that in any redevelopment project, the voice of the dissenting minority could not be quelled, and that the onus of bringing around the objecting member lay on the housing society. The order had dashed the hopes of many redevelopment projects taking off in the city. However, Chief Justice Swatanter Kumar and Justice Ajay Khanwilkar held on Thursday that "merely because some members in minority disapprove of the decision, it cannot be the basis to negate the resolution of the general body". |

I also kept track of this news and got really surprised when the very next day exactly opposite judgement was delivered. Anyway, it may be a boon for big housing societied struggling for redevelopment but, can be ??????? for smaller one.
