OPEN CHEMASIM - Another "open source" software simulator

Quick note to inform you all I came across another "open source" process siulator OPEN CHEMASIM - http://chemasim.itt.uni-stuttgart.de/index.html. It is open source with an entry fee!!! I came across them when I recieved the program for PSE ESCAPE conference where they will be giving a presentation on the 10th of July - OPEN CHEMASIM: breaking paradignms in process simulation.

I found this the other week when we were looking at names. I do not
think it can be really called open source as:

Obligations of OPEN CHEMASIM™ Users

"What are your main obligations as an OPEN CHEMASIM™ User? Most
importantly: you agree to participate in OPEN CHEMASIM™ and accept the
user agreement. OPEN CHEMASIM™ is a non-commercial system. This
basically means that you share your OPEN CHEMASIM™ related
developments with the other users. And you need to make sure that OPEN
CHEMASIM™ is not distributed to third parties."

It is open within its group but cannot be distributed outside that group.

Dear All,

OPEN CHEMASIM is no way Open Source!
I sent a letter to the Open Source Initiative (OSI) and they contacted
the authors recommending to use the therm "Source Available" and not
"Open Source", it follows the answer from Russ Nelson from OSI:

Hi. You say on your front page that OPEN CHEMASIM is Open Source,
however, http://chemasim.itt.uni-stuttgart.de/about/index.html#user
says that OPEN CHEMASIM may not be distributed to third parties. It
also says that the source is only available to academic institutions,
not individuals. It also says that commercial activity is excluded.

I understand that it's more open than it used to be when it was at
BASF, but an unlocked closed door is still closed to some users and
some uses.

Please don't call it Open Source. I recommend the use of the term
"Source Available", because it says that you can get the source, but
it's not open for all uses and all users.
