Portia spoke to Joseph from Joseph and Sons over the weekend.  He said he is Not planning to do a hotel and is back to building a warehouse.  and he did not want to attend a meeting with us. 

 

At this point there is no need to meet, one thing that we need to do though is to check with DOB and see if new permits are being filed. I have a expeditor that offer some assistance and I will ask her to go to DOB and get all records.

 

Portia, is there something else to add?

Hi Portia et al,

I'm happy to get on a conference call & go over any of the following:

As an adjoining property owner, the law & NYC Building Code provide you with many rights & protections.
I dont think the owner/developer can start digging in 2 weeks without an agreement from you (especially if he is going to expose your foundation.)
I believe a 'pre-construction' site survey, including your property, is required by law, before they start digging.
Additionally, they will need to provide you with their plans for:
  • your roof protection, since they are building higher than you
  • extension of your chimneys, since they are building higher than you
  • treatment & water-proofing of the 'seismic gap' (the gap between the 2 buildings)
You also need to understand & get their excavation plans & proof of their insurance.
To do the 'pre-con site survey' & for the possible installation of 'movement monitors", they need to access your property - I would allow them to do this; it ultimately serves you.
The 'monitors' automatically gauge the movement of your building as they excavate & build their foundation (you don't want your building to fall over...)

However, all the above requires a standard 'License Agreement' between you and your neighbor, where access, the above mentioned issues, and re-imbursement of your expenses are all spelled out.

To do this, you need to engage a lawyer and an engineer.
The lawyer negotiates and drafts everything, based on info provided by your engineer's site visits.
You need them both.
The lawyer is not your standard, real estate contract attorney (who did you purchase contract & closing.)
You need to use a "Design & Construction" attorney.

Yes, they cost money, but the cost is covered by your neighbor & is part of the License Agreement.
You & all your neighbors are sitting on $1M++ properties, so this is not an expense to skip, unless you want to be steam-rolled, literally & figuratively.

My neighbors and I have been able to shut down the shady developers near me 5 times, for working illegally & improperly, and now they cannot begin working again (excavating) until they have executed a License Agreement with me & the other neighbors.

I am sorry to report that I spoke to Angela Orlando of Powers Street (the other neighbor adjacent to the lot) and  She said her son spoke to  the developer and he told them the hotel is definitely still planned- he vehemently told me just a warehouse in January.  We both received a letter yesterday that digging should start within 2 weeks. 

Also I can no longer find on the DOB website under -14 Olive - so it seems like a shell game to keep the project moving.  I will search again but wanted to get this email out quickly.

I saw them doing visual planning on the building yesterday, you can see the spray paint on the sidewalk in front of the garden.
