An elderly family friend (couple with disabilities)were evicted from
their home. They were to be out by the end of September and had
secured alternate housing. They had a court date at the end of
September to ask for an additional 30 to get help/movers to move their
belongings. The landlord did not show up at court and the judge
granted the addtional 30 days (which would have given them until the
31st of October), to remove their belongings. The mover was not able
to take everything but the couple told the mover they would get the
rest of the boxes themselves. They went back on the 29th of October
to remove the rest of their belongings and were met at the door by
people who were throwing the rest of their stuff away. They were
intimidated and left when they were told they were tresspassing and if
they didn't leave right away the police would be called. They now
have a court date set for the 20th of December and the landlord is
sueing them for $2900. All I know that they owe is $700 for one
month's rent. They lived there for well over 10 years so wear and
tear on the property is not a consideration and it couldn't have cost
$2200 to clean it. (They also would have cleaned if they had let them
in the day they went to get the rest of their boxes.) In the
meanwhile, the items they through away were a full collection of
Barbie Dolls (still in the original packaging) dating back to when
Barbie first started, military medals, and family memoriabilia,
jewelry and military medals from Germany. To put a price on this
would be almost impossible!
My question s are: Is there a law in OH which states how long a
landlord has to store items left in a leased apartment or home? Is
there a free attorney service that specializes in these types of
cases, (they are on a fixed income)? The court date is coming up and
we need to try to find some answers for them asap. Any help is
appreciated!!!
