Ok, let's go with a forward line doesn't constitute a derivative. I took out my part of the conversation as well because I didn't think it added anything, and they can't really license my writing. :)
If you have questions about Headphonica, Android, their proposed Android app or anything else related to Creative Commons, I'll be happy to discuss and/or send out my part of the conversation with them. You can find Headphonica at
http://identi.ca/headphonica and you can see some discussions I've had with them by checking them out there.

yes, due to authenticity it's cool to take this in its entirety.
let's say this email is licensed under CC-BY-ND [ND for details not

sorry for being so slow with replying - that doesn't mean that we're
not interested, but that we're a bit slow, sometimes. ["we" is clemens,
tommy & martin from headphonica - actually it's me, martin, writing
here]
so, thanks a lot for offering your help with an andriod-app - we
appreciate this very much!
the thing is: (at the moment) we're not using those shmart-phones
ourself and we're not very good in programming/coding, so we can't be
that helpful with creating the app itself. obviously it would be a good
idea to put out a call - we could also announce this on identica.
i had a look at that android-market to find out what's offered there
and i was surprised of what's going on there...
considering a kind of radio or easy downloading it could maybe be both.
i think of what notheen [a cc-based webradio] does in their livestream:
http://www.notheen.com/ > lots of the tracks
they're playing have a link ("+") in the playlist from where you're
directed to the netlabels site.
maybe it would be useful to stream the music in *.ogg (~128kbps) and
maybe we should make a testing if it's better for gapless streaming to
host the files on headphonica.com or
on archive.org
then.
i also made a small series of tests with re-compressing ogg-files from
the mp3s (mp3 in 320kbps to ogg in 128kbps) which all sound a bit odd,
but it might sound ok on a phone...
ok, so far.
please get in touch with any concerns/ideas/whatsoever, ok?
and thanks once more for offering help!
many greetings from hedaphonica,
martin [+tommy + clemens]
p.s.: about the netlabels/cc-labels-movement > i attached a
scientific study (i think it was sociology) about so called "netlabels"
from 2008 - you can find more information about that here: http://phlow-magazine.com/feature/1076-netlabel-research-numbers-results-paper
and last week i've been to a congress in berlin (a2n - alltogethernow)
where one of those netaudio/cc-experts told that there are somewhat
about 5,000 to 10,000 (in words: betweeen five- and tenthousand)
netlabels releasing music under creative commons.
you'll find out that this is a movement which is very elaborated/strong
in europe, especially in germany... proof: compare the english
wikipedia-site about netlabels http://en.wikipedia.org/wiki/Netlabel
with the german version http://de.wikipedia.org/wiki/Netlabel
