Hi Folks, in plain language, the Canadian Charter of Rights and Freedoms, the Ontario Human Rights Code, and the Statutory Powers Procedures Act are 3 different "rule books" that apply to ODSP. The Code and the SPPA are lower level rules than the Charter. Only the Charter is a judicial process that can actually strike down some/all of the ODSP Act. I/Dave am making a Charter Argument because it is the only way to win a ruling that will help Other Disabled Folk, not just Dave.
I/Dave argue the ODSP Act enforcement process violates the senior rule book, the Charter. If/when the ODSP Act Director's Decision Conviction Process is stopped ODSP won't be able to enforce any of its bad rules. ODSP would have to create a new, fairer, process before they could punish any more Disabled Folk.
Right Now the ODSP Act is discriminating against Disabled Folk in 2 ways 1) ODSP punishes disabled people without due process; 2)fear of ODSP punishment causes disabled people to obey unfair rules that harm them, or risk losing the only income they have.
Folks, although ODSP certainly discriminates against disabled people, Dalton has always respectfully tolerated my activism. I am always peaceful, courteous, and respectful, even when I mock him. Nothing bad has ever happened to me because I spoke out against ODSP.
Dalton has clearly proved to Me/Dave that if a disabled person breaks a ODSP rule the disabled person will be punished. BUT if a Disabled Person speaks out against ODSP Dalton's Ontario Government will actually listen, Dalton might not fix the problem, but they actually listen. Cool eh :)
Folks for a long time I have been lobbying Dalton and I was never punished for it. The key is to be courteous, polite, and truthful and Dalton's Office will listen. I know because even now, after all this time, Dalton still occassionally replies to me by email.
Folks, what would you like to tell Dalton about ODSP? What would you like to ask Dalton about ODSP? His Office reads Fireside. I emailed Dalton, M. Meilleur, Jim Brownell, and Michael Doi again this morning. Here is the text:

Folks Dalton is a good man in a difficult situation. I/Dave think Dalton knows the ODSP Act is bad legislation but fears angering voters by fixing a complicated and expensive problem that only affects a disabled minority. I like Dalton's Government, I am just trying to get Dalton to fix one particular problem. I mock Dalton as "Premier Dalton Chicken McGuinty" head of the Ontario Government, but not as a Person.
Folks we are very lucky to live in a wonderful democracy having a public internet dialogue about ODSP. I hope my work energizes and empowers Disabled Folk to publicly, speak out against ODSP, here on Fireside.
