I have a real problem with something. I am working with a client who has a pay direct to the landlord from ODSP. (includes rent & gas). However, since May 2010 his service has been cut off  for non payment. I contacted the Income Support Specialist ( now thats a joke)  at ODSP to inquire. I asked if it was not their duty to ensure that the landlord was doing what he said he would .( this client has a signed agreement with the ladlord that ODSP REQUIRED them to do -to set up the pay direct) 
 I was told that its not their problem that the Tenant would have to make applicaton to the Trbunal. and I quote: "ODSP is not in the property busness and that the tenant would have to fight it himself"
 
Fortunately I was able to have ODSP stop the September pay direct. I decided to stick my neck out and talk with the Landlord to rectify the situation before he gets another cent from my client. He will ahve to talk to me -- I have his money..
 
My issues is THIS: 
 
Everything WE as ODSP recipients bring in $$$  we MUST report or we are cut off our benefits. So why arent these slumlords not held accountable to the ODSP purse? At least they should provide the bills for which the money they recieved was to pay for on behalf of the tenant.. This has never happened for this tenant sicne he took occupancy.. I estimate that he shoudl be getting appox 250.00 credit to Sept's rent due to overpayment to this landlord. then he can put that down on his hydro and get his servcies back on.. WORKS! it just took someone to pay attention and push the right buttons..   
 
Something has to change... why does the system BLAME the victim .... ???????

Actually im going through this as an odsp recepeient right now. mine is a little diffrent. thet landord before and after they amalgamted for 3 years let odsp pay them direct for the 1st of the month at the end of the month. these guys now decide to catch up on thier books and say okay all you odsp people your now in arrears. I  took them to the landlord and tenant board but i ended up withdrawing the application so i could take them to human rights tribunal witch im currently in, they have till the middle of septmeber to respond. bacially they took our accomadtion away and put us in arrears, we shouldnt even be involved it was set up between odsp and my landlord.And we were coherced into signing an agreement the line read if you dont sign by this date you may get a letter to vacate. I ended up having to use the Community start up benefit.So you know how furiious i am. so my human rights case is discrimantion agaist disaiblty and receing soical assitance plus harrasment. What im dissapointed in. is im the only one on odsp in my building who is fighting it. the others for various reasons. jsut accepted it. Im totally alone in this.

Ben,

That's part of why many of us will not live in subsidized
housing.  Their rules are too intrusive, and they prohibit
anybody from getting out of poverty; as well, in situations
like yours, you are being abused where you should feel
safe: in your own home.  I wouldn't take that sort of thing
from that either, but when I was in subsidy, I stopped the
subsidy instead of quitting my job, which they were trying
to force me to do.

this client is not in a subsidized unit.. he is with a notorious slumlord. I am taking my client to the bank today to get his rent and he is instructed to have the landlord call me to get it.. I will make a demand that the gas be turned on and the unit have its necessary repairs.. ie: a kitchen sinhk and bathroom toilet that actually work... ... or no money.. 
let him try  something -- i dare him... :))

I would refer your client to a legal clinic in your area.
 
He/she can be evicted for withholding rent, even if it is
for a good reason.  That is probably why the worker told
you to go to the Tribunal.

the gas has been turned on .. i still will pay the rent ,.. but only the rent not the extra fro the gas bill that the landlord was supposed to pay from the money he got each month from the tenant.. until he can show me that the bills are paid... and how much.. i think the amount he got from the tenant was a lot more than the actual  bills .. i want the tenant to have the overpayment taken from this months rent money.. if there is any
then i will turn it over to tribunal if the  lld doesnt give us an acounting of the costs for gas ..

Can't you take the landlord to the Tribunal? It's my understanding that you can apply for a rent abatement if the landlord is not keeping up his/her responsibilities. You can get the rent abatement retroactive, too i.e.. To when the gas was shut off. I hate that some people feel they can get away with treating tenants like that, there sure are some awful landlords out there. I hope you are successful at getting something done.

I will do things legal.. its the only way to enforce anything.. but an informal meeting and mediation sometimes can solve the problems..
