Say over who manages my Henson Trust?

Hello fellow ODSP folks,

My inheritance is in the form of Henson Trust that’s managed by my eldest sister. As an ODSP recipient, do I have any say over who manages this Henson Trust, on my behalf?

It seems to me that I don’t, and that the only person who can pass my inheritance on to the OPG [Office of Public Guardian and Trust] in my case, is my sister?

Problem is, my sister and I have never been able to cooperate, and given my severe PTSD [Post Traumatic Stress Disorder] trying to deal with her just inflames my condition.

I’ve requested that she, with the help of her lawyer who asserts that he’s running my inheritance, to please transfer my inheritance to the OPG. She seems to be refusing to, while recommending I deal with her lawyer on the smatter. Problem is, I’ve been trying to get a response from her lawyer, and I’m continually stonewalled by the receptionist - as has been the case for the past year.

So, am I correct in my understanding that I have no say in this matter of who manages my inheritance, in the form of this Henson Trust?

Also, does anyone know of information sources for Henson Trusts? Legal Aid and similar free resources don’t deal with Trusts, such as mine.

Bill,

The only one who can change things, as I understand it, is the person who set up, or has control of, the trust.

I had similar concerns, but in my case the person who created the trust was still alive. He agreed there was a problem and changed things.

The lawyer he used was one in Peterborough. He was expensive. Dad paid him. Legal aid does not cover it. If you still want his name, let me know. I’ll share it.

It’s bad that ODSP limits our rights so much.

It sounds like your request is reasonable. Have you asked the PGT to assist you in approaching your sister and/or her lawyer?

This is another legal disaster in Canada ,law is not for the people,the law is for who can effort yet still you may get no where even if you pay,that is disgusting situation in Canada.Law,law society(bullshit society),cabals,politics,big cooperations,banks,the law is for those ss holes only to use to fck others.
