How does ODSP deal with WSIB lost wages?

Do they take it like employment income at 50% or do they class it
under "other income" and take it at 100% I ask because my husband had
an accident at work and will be off for a month or more and we need to
be prepared. I cant find anythign about lost wages in the directives,
only non economic loss.

I know it is a way off still for WSIB to start working to get this
resolved, but I really want to be prepared

Well that stinks, that means we lose the drug card and daycare benefit
for him getting injured, as we were under the limit with the 50% taken
off but not the 100% taken off, and since it is not "employment"
income, no extended health benefits either. I know WSIB will cover him
for his meds, but for me and my son, we are out of luck. I will have
to take my son out of daycare and quit my schooling(upgrading) because
of not being able to pay for it without being able to deduct it off
his salary. Once I take him out, I lose the spot and have to be put
back on the waiting list to get him back in.

Does the 100% count if it comes directly from his employer? His
employer is going to prepay a few weeks of wages to him and then apply
to get reimbursed by WSIB, it will come in his bank account from his
employer and look like any other pay

WSIB Loss of Earnings (LOE) benefits is taken off
dollar for dollar as "other income".

Sadly, you've found another vital flaw in this esteemed system.

Might I suggest a letter to the editor of several papers to say exactly what you said here? You're explanation of what you will loose because of an accident, not an act of carelessness or irresponsibility on you or your husband's part, might expose even more of the abuse we face on this program.

Every single thing you name here shows strength and determination to get ahead. An accident should not force you to give that up.

I think it is possible to make a case for extended health benefits
while not on ODSP, especially if medical costs are extensive, and if
you're returning to ODSP once the lost wages are dealt with.

I made a mistake in a previous post, we will get a drug card because
it turns out we will be a bit under the limit


That seems like punishment for getting injured, not help for getting
injured. The system in this regard is definitely broken. WSIB is
designed so you wont lose too much income if you get injured at work.
Now we will lose a significant amount of income and benefits for him
getting injured.

Please note we have to still pay childcare for the month to keep the
space so I can go to school and for when he is back to work. My
husband is unable to look after him during this time as he is on heavy
pain meds

Would that be the basis of a human rights complaint? It is really
discrimination against injured workers,






Instead of getting a total of $2567 from work and ODSP after paying
childcare, we will now only get $1717

This is calculated as follows:

BEFORE ACCIDENT:

Work income $1609 (after deductions)
divide by 2 = $804.50
minus childcare $354.50

Total to be deducted from ODSP check $354.50


ODSP income $1663
minus employment income = $1308
plus $100 work benefit = $1408

Total income $3017.50
minus childcare = $2567.5


Total usable income before accident - $2567.50




AFTER ACCIDENT:

WSIB income $1609

ODSP income $1663
minus WSIB income = $54

Total income = $1717
minus childcare = $1267

Total usable income after the accident $1267



Real difference between before accident and after accident income =
$1300.50



So it is a total loss of $1300.50, more than half of our regular
income and actually less than we would get if he had never worked and
just stayed at home.


We cant afford for half of our income to be gone, especially with all
the up front costs of transportation to the hospital for appointments,
and everything else, and I am sure no one else could either.


Its it punishment for the injured worker, not help

If anyone finds out how, please let me know. I thought so too. That's why I left the whole thing with the Community Legal Clinic.

The thing is, the clinic was too busy so they didn't get time to respond until day 33.... too late to launch an appeal through the social benefits tribunal.
