I am writing to the Board of my own opinion. I am not representing anyone other than myself. And, by "Happy Saturday", I mean to highlight that I am writing this email from my personal email account on my personal time.
On July 1, 2025 a document was recorded at the Register of Deeds office which was unique. This regards parcel identification number (PIN) 9778-37-0093 . This regards the Carrboro multi-residential property known as Chateau Apartments. The most recent tax bill, a public record, indicates that the assessed value of the real property is more than $18 million and that the outstanding tax bill is $278,858.95 with interest beginning January 6, 2026.
The document is recorded on book 6883 page 1781. This instrument prepared by Nelson Mullins Riley & Scarborough LLP in downtown Charlotte, NC. The document is titled "REGULATORY AGREEMENT AND DECLARATION OF RESTRICTIVE COVENANTS". The recording further states that CHATEAU APARTMENTS NC, LLC is in agreement with "OPPORTUNITY SOUTH CAROLINA, a South Carolina nonprofit corporation, whose address is 1521 Laurens Road, Unit 17481, Greenville, South Carolina 29606 ("Grantee" or "Non-Profit")."
It appears that the owner of the real property is Carrboro Apartment JV, LLC c/o Matheson Capital, LLC 304 Meeting Street, Suite 200C Charleston, South Carolina, SC 29401 Attn: Will Matheson .
The instrument uses the phrase "affordable housing" and I invite you to read the nine-page, public record. Please notice exactly who signs for the owner and for the non-profit. The instrument also states "WHEREAS, in connection with obtaining an exemption from real property taxes ..."
Is this a Delaware corporation acting through a South Carolina non-profit for tax purposes?
Is this a South Carolina non-profit wanting to help low-income people more than two hundred miles away in another state?
Opportunity South Carolina has a web site!
The web site is not even disguised as a non-profit acting to assist low-income people. Not even one stock photo of happy adults with keys in front of a modest home. There's plenty of statements on lowering taxes paid on the behalf of investors!

But, wait, there's more!
So I checked the public records for any additional recordings with "Opportunity South Carolina" indexed as a grantor or a grantee. Yes, there is one more on book 6868/page 521 also titled "REGULATORY AGREEMENT AND DECLARATION OF RESTRICTIVE COVENANTS". This relates to PIN 9865-50-3608 which is a multifamily, residential property in the Town of Hillsborough. The January 28, 2025 recording involves a different corporate owner in Raleigh for the Hillsborough property assessed at $1.2 million tax value and an outstanding tax bill of $21,456.93 .
I am skeptical of "Opportunity South Carolina", or Mark Elliott, of truly being an altruistic agent of housing and empowering low-income folks. It seems more likely that Mark Elliott wants to turn a buck.
If one has questions, then I must state that I have no further answers. If one has questions, then one may ask a licensed attorney or the Office of the North Carolina Attorney General.
My sense is to treat Opportunity South Carolina like hydrilla found in the Eno River.
