I’ve brought this up before here:
I sincerely ask the County Commissioners to review the county dog bite laws. My leashed dog was attacked by a pitbull that dug under the fence in its yard snd came off its property and attacked my dog. The pit owners refused to pay my vet bill and took no responsibility for their dog’s actions.
I took them to court to get my dog’s vet bill reimbursed. I presented the vet bill, the animal control report, and a witness testimony to the judge. The pit owners still refused to reimburse me. The Orange County judge said the “one bite rule” does not give him authority to have them reimburse me. Actually NC is a one bite rule AND a strict liability state. No one, including the judge understands the one bite rule. The presiding judge did not understand much.
Most states are getting rid of the ridiculous “one bite rule.”
There are exceptions to the “one bite rule “ such as when a dog is off its property and runs up to another dog and attacks it. As this pit did to my dog.
My dog and I were victims of the vague and misunderstood dog bite ordinances that protected the pit bull/family that attacked my dog. Something is wrong with a system that protects the aggressing dog and throws the victim dog under the bus.
A dog that is off its property, off leash, and runs up to a leashed dog and attacks the dog and causes injury is the aggressor. The attacking dog owners are responsible for the damage their dog causes. Common sense. Decency.
How could such a ridiculous ruling be made by an Orange County judge?
