For the past 2 weeks, our contractor at 3000 Damascus Church Rd has attempted to obtain a temporary power permit for the construction of our 2000 square foot barn on the property. Piedmont Electric has completed its work. The contractor is ready to go. Of course, OC has halted all progress. Michael Rettie informed me on Friday September 24, 2021 that OC does not provide temp power to bona fide farms and suggested, on a recorded call, that I should instead run generators to construct our barn.
Keep in mind that to the south of my property lives an elderly retired couple, Warren and Lynda Womble. To the north of my property is my preschool on 3100 Damascus Church Road. This preschool's forest playground is adjacent to the construction of the new barn. Both the Wombles and my students will endure multiple generators running throughout the day for the next two month should we decide to follow this foolish advice.
Below, you will find the 2017 NC Electrical Code section on Temporary Power. In short, the regulations state that "the Code enforcement official shall give permission and issue a permit
to energize the electrical service when the provisions of 10.8 and the
following requirements have been met" (emphasis added).
As I am not an electrician, I can only assume that such a statement means a permit is required to be issued as long as the listed requirements have been met. Michael Rettie, however, has stated that, although OC follows the NC Bldg Code, OC does not ever issue temp power to bona fide farm construction projects.
Is this possible - that you all require all construction projects on land designated at bona fide farm to hook up some generators to actually construct buildings? If so, what is the reasoning? Mr. Rettie stated repeatedly that "this is what we normally do". When I pressed him to speak to OC rules and regulations, rather than "what we normally do," he was unable to do so. He stated he did not know where to find the applicable rules and that it would take him 2 days to look for them. He then stated that I could send him a PRR, which of course is not accurate. Todd McGee receives and responds to PRRs in OC. This does seem beyond the scope of a PRR and should be well within the purview of Mr. Rettie.
We would like a written decision from OC that, indeed, OC does not issue temporary power permits to bona fide farm construction projects under any circumstances. We plan to appeal this decision, but must have our application rejected on those (or some) grounds first - in writing.
Either issue the permit for temporary power immediately or deny our application for temporary power immediately.

10.8 TEMPORARY POWER
10.8.1 Scope. The provisions of this section apply to the utilization of portions of the wiring system within a building to facilitate construction.
10.8.2 Provisions for Temporary Power. The Code enforcement official shall give permission and issue a permit to energize the electrical service when the provisions of 10.8 and the following requirements have been met:
1) The service wiring and equipment, including the meter socket enclosure, shall be installed, the service wiring terminated, and the service equipment covers installed.
2) The portions of the electrical system that are to be energized shall be complete and physically protected.
3) The grounding electrode system shall be complete.
4) The grounding and the grounded conductors shall be terminated in the service equipment.
5) At least one receptacle outlet with ground fault circuit interrupter protection for personnel shall be installed with the circuit wiring terminated.
6) The applicable requirements of the North Carolina Electrical Code apply.
10.8.3 Uses Prohibited. In no case shall any portion of the permanent wiring be energized until the portions have been inspected and approved by an electrical Code Enforcement Official. Failure to comply with this section may result in disconnection of power or revocation of permit.

10.8.4 Application for Temporary Power. Application for temporary power shall be made by and in the name of the applicant. The application shall explicitly state the port portions of the energized electrical system, mechanical system, or plumbing system for which application is made, its intended use and duration.
10.8.5 Security and Notification. The applicant shall maintain the energized electrical system or that portion of the building containing the energized electrical system in a secured and locked manner or under constant supervision to exclude unauthorized personnel. The applicant shall alert personnel
working in the vicinity of the energized electrical system to its presence.
