Updating this topic once more. This morning the Colorado Supreme Court issued its unanimous opinion against the town and in favor of the cyclists.

Justice Hobbs's opinion contains a history of the town and of Colorado cycling that may interest even non-lawyer list members.

It is probably the most significant bike centric litigation I have seen in terms of total scope

 

The Bike Colorado group really have it together

 

The representation, trial through appeal, was a pro bono effort by lawyer/s who were members of the Bike Colorado's board of directors
