LEGAL UPDATE:

The Supreme Court decision held our case be remanded to the Court of
Appeal (COA) on July 9. The COA is where the STAY on "cutting of trees
and all landscape altering activities" was issued. To the best of our
legal team's understanding that STAY is in effect until the COA’s
opinion reversing the trial court’s denial of our original CEQA case is
finalized. Our team does not think that could happen before July 9 when
jurisdiction of the case is returned to the COA, so People’s Park seems
to be solidly safe till July 9.
After July 9 our case is in the jurisdiction of the COA for an unknown
period of time. Then it is to be remanded by the COA back to the trial
court where Judge Roesch’s decision for denial of our CEQA petition
would be reissued.
It is not clear when the COA decision is considered finalized. It could
be when the COA remands the case back to the trial court or it could be
when the trial court has reissued their decision. Not to be overly
optimistic but there is some chatter that the COA is not happy about
either the Legislature end running CEQA or the Supreme Court reversing
their decision. Maybe they will drag their fee a bit.
We are trying to get more exact information but wanted you to know about
the July 9 date. That date is also important because in its
anticipation our lawyers are filing a request for attorney’s fees on
July 5.

Students shouldn't have to waive their first amendment rights in order
to receive a higher education in California. Protect free speech on
college campuses. Take action to oppose SB 1287.
We need you in Sacramento this TUESDAY, JULY 2 at 8:30AM!!
The Assembly Judiciary Committee, chaired by Ash Kalra, will hear SB
1287:(Glazer) Public postsecondary education: Equity in Higher Education
Act: Prohibition on violence, harassment, intimidation and
discrimination" - the bill that will limit student free speech and the
right to protest.
In order to enroll, students will have to sign their acceptance of a
Code of Conduct that will give administrators power over where and how
they can protest. Its sponsors introduced it as a way to "protect"
students from the "antisemitic" harassment and intimidation they
experienced from the student encampments. The bill is an attempt to
frighten and bully students into silence.
On Tuesday morning, the bill will go before the Judiciary Committee.
While only 2 witnesses will be allowed to testify in favor and 2
against, each side can have an unlimited amount of "me too'ers" - people
who come to the mike, say their name, where they live, what org if any
they're associated with, and if they're for or against the bill.
It is very impressive for legislators to see a large number of people
who believe this issue is important enough to travel all the way to
Sacramento to be seen and heard!
Please show up in Sacramento in time for an 8:30am PT Judiciary
Committee hearing.

believe in the right to protest on this issue – and any other!!

The Fight to Save People’s Park

Berkeley continues. The park was listed on the National Register of
Historic Places, and an important Court of Appeal victory was won.
However, UC appealed the court decision to the State Supreme Court and
simultaneously subverted the court victory by getting the legislature to
pass a bill to undermine it. Construction is halted until the court
issues its decision. Organizing strategies are still being pursued to
protect the park from destruction by a huge student housing project and
the paving over with hardscape, despite the need for open space in the
densest part of Berkeley. This Zoom panel will also talk about how
privatization is pushing the monetization of the public assets of the
University and how this process has become a national trend.
