Unless Israel changes course, it could be legally culpable for mass starvation

Gaza is experiencing mass starvation like no other in recent history.
Before the outbreak of fighting in October, food security in Gaza was
precarious, but very few children – less than 1% – suffered severe
acute malnutrition, the most dangerous kind. Today, almost all Gazans,
of any age, anywhere in the territory, are at risk.

There is no instance since the second world war in which an entire
population has been reduced to extreme hunger and destitution with
such speed. And there’s no case in which the international obligation
to stop it has been so clear.

These facts underpinned South Africa’s recent case against Israel at
the international court of justice. The international genocide
convention, article 2c, prohibits “deliberately inflicting [on a
group] conditions of life calculated to bring about its physical
destruction in whole or in part”.

In ordering provisional measures to prevent potential genocide last
Friday, the ICJ didn’t rule on whether Israel is actually committing
genocide – that will take years of deliberation – but the judges made
it clear that the people of Gaza face “conditions of life” in which
their survival is in question. Even Justice Aharon Barak, appointed by
Israel to sit on the panel, voted in favour of immediate humanitarian
relief.

But a humanitarian disaster such as Gaza’s today is like a speeding
freight train. Even if the driver puts on the brakes, its momentum
will take it many miles before it stops. Palestinian children in Gaza
will die, in the thousands, even if the barriers to aid are lifted
today.

Starvation is a process. Famine can be its ultimate outcome, unless
stopped in time. The methodology used to categorize food emergencies
is called the integrated food security phase classification system, or
IPC. It’s a five-point scale, running from normal (phase 1), stressed,
crisis, and emergency, to catastrophe/famine (phase 5).

In categorizing food emergencies, the IPC draws on three measurements:
families’ access to food; child malnutrition; and the numbers of
people dying over and above normal rates. “Emergency” (phase 4)
already sees children dying. For a famine declaration, all three
measures need to pass a certain threshold; if only one is in that
zone, it’s “catastrophe”.

The IPC’s famine review committee is an independent group of experts
who assess evidence for the most extreme food crises, akin to a high
court of the world humanitarian system. The committee has already
assessed that the entirety of Gaza is under conditions of “emergency”.
Many areas in the territory are already in “catastrophe”, it said, and
might reach “famine” by early February.

Yet whether or not conditions are bad enough for an official
declaration of “famine” is less important than the situation today,
which is already killing children. Bear in mind that malnutrition
makes humans’ immune systems more vulnerable to diseases sparked by
lack of clean water and sanitation, and that those diseases are
accelerated by overcrowding in unhealthy camps.

Since the IPC was adopted 20 years ago, there have been major food
emergencies in Afghanistan, the Democratic Republic of the Congo,
Ethiopia’s Tigray region, north-east Nigeria, Somalia, South Sudan,
Sudan and Yemen. Compared to Gaza, these have unfolded slowly, over
periods of a year or more. They have stricken larger populations
spread over wider areas. Hundreds of thousands died, most of them in
emergencies that didn’t cross the bar of famine.

And in the most notorious famines of the late 20th century – in China,
Cambodia, Nigeria’s Biafra and Ethiopia – the numbers who died were
far higher, but the starvation was also slower and more dispersed.

Never before Gaza have today’s humanitarian professionals seen such a
high proportion of the population descend so rapidly towards
catastrophe.

All modern famines are directly or indirectly man-made – sometimes by
indifference to suffering or dysfunction, other times by war crimes,
and in a few cases by genocide.

The Rome statute of the international criminal court, article
8(2)(b)(xxv), defines the war crime of starvation as “intentionally
using starvation of civilians as a method of warfare by depriving them
of objects indispensable to their survival, including wilfully
impeding relief supplies as provided for under the Geneva
conventions”.

The main element of the crime is destruction and deprivation, not just
of food but of anything needed to sustain life, such as medicine,
clean water and shelter. Legally speaking, starvation can constitute
genocide or war crimes even if it doesn’t include outright famine.
People don’t have to die of hunger; the act of deprivation is enough.

Many wars are starvation crime scenes. In Sudan and South Sudan, it’s
widespread looting by marauding militia. In Ethiopia’s Tigray, farms,
factories, schools and hospitals were vandalized and burned, far in
excess of any military logic. In Yemen, most of the country was put
under starvation blockade. In Syria, the regime besieged cities,
demanding they “surrender or starve”.

The level of destruction of hospitals, water systems and housing in
Gaza, as well as restrictions of trade, employment and aid, surpasses
any of these cases.

It may be true, as Israel claims, that Hamas is using hospitals and
residential neighbourhoods for its own war effort. But that doesn’t
exonerate Israel. Much of Israel’s destruction of Gazan infrastructure
appears to be away from zones of active combat and in excess of what
is proportionate to military necessity.

The most extreme historical cases – such as Stalin’s Holodomor in
Ukraine in the 1930s and the Nazi “hunger plan” on the eastern front
during the second world war – were genocidal famines at immense scale.
Gaza doesn’t approach these, but Israel will need to act decisively if
it is to escape the charge of having used hunger to exterminate the
Palestinians. Starvation is a massacre in slow motion. And unlike
shooting or bombing, the dying continues for weeks even if killing is
halted.

This is the challenge facing the UN security council when it will soon
debate the ICJ’s provisional orders to Israel. Just allowing in aid
and putting some restraints on Israel’s military action are not going
to stop this thundering train of catastrophe quickly enough.

More than a month ago, the famine review committee wrote: “The
cessation of hostilities and the restoration of humanitarian space to
deliver this multi-sectoral assistance and restore services are
essential first steps in eliminating any risk of famine.” In other
words, an immediate end to fighting is essential to prevent a
calamitous toll that may far exceed the numbers killed by violence.

That’s the operative line. For the survival of the people of Gaza
today, it doesn’t matter whether Israel intends genocide or not.
Unless Israel follows the famine relief committee recommendations, it
will knowingly cause mass death by hunger and disease. That’s a
starvation crime.

And if the US and UK fail to use every possible lever to stop the
catastrophe, they will be complicit.

most likely refer to the eyes and ears as primary vehicles for sensory
contact with the outside world. In general, Han philosophy does not
celebrate denial of the senses for its own sake. At the same time, many
texts recognize that sensation seeking deters one from reverent attention
to social duty. Driven by desire, a person "is agitated, with his thoughts
helter-skelter." One classical text says:

The people are born good. It is because of [desires for] external things
that they change. If this is so, then to preserve Man's original potential

was a thornier problem, as it touched upon a host of problems which

- What can humans reasonably hope to accomplish in this life?

In the Han Confucian synthesis, then, the proto-scientist's impulse towards
categorization and the logician's search for orderly expression joined
forces with the ethical concerns of the traditional scholar. Categorical
thinking, inherently preoccupied with the relation of macrocosm to
microcosm, came to be applied to many areas of inquiry, most significantly
(1) portent theory; (2) the rectification of names; and (3)
point-by-point analogies between the human body, the body politic, and
the universe. We are familiar enough with body analogies; we often talk of
"heads of state," for example. Portent theory and the rectification of
names, however, may need some explanation for the modern reader. {NYLAN,

The impact of YANG HSIUNG'S PHILOSOPHY on later Chinese thought is
undeniable. The historian PAN KU (32-92 CE) revered YANG HSIUNG as one of
the THREE GREAT CONFUCIAN PHILOSOPHERS OF WESTERN HAN, in company with LIU
HSIANG and LIU HSIN. PAN KU'S opinion was shared by the leading Eastern Han
thinkers, including HUAN T'AN, WANG CH'UNG, CHANG HENG, YING SHAO, and Sung
Chung, all of whom appreciated the breadth and critical acumen of YANG
HSIUNG'S writings. Through them, the T'AI HSÜAN provided inspiration and
vocabulary for the HSÜAN HSÜEH movement (in Chinese, "Mystery Learning") of
the post-Han period. The Mystery, in fact, continued to greatly influence
Chinese thought for a millennium, until prominent SUNG thinkers like SU
HSÜN (1009-1066) and CHU HSI (1130-1200) applied contemporary standards
retroactively to YANG HSIUNG, thereby discrediting him on three counts:

(a) his service at the court of the "usurper" WANG MANG (r. 923);

(b) his outright rejection of the theory of human nature proposed by the
Confucian master Mencius (c. 371-289); and

(c) his supposed presumption in composing ''classics" in imitation of the
sages. [NYLAN, pages 1, 2]

Of course, YANG HSIUNG could claim to be emulating the model of Confucius,
who "seldom spoke of ming," presumably because the most sacred aspects of
human existence are taboo. But it is no less likely that YANG'S reticence
is meant to entice the reader to embark upon that step-by-step immersion
in the sage-author's mind that SCHOOLS THE READER IN THE MORAL PROCESS
ITSELF.

YANG HSIUNG imbedded the necessary clues to his solution for ming in three
linked statements. The longest passage begins:

Someone asked about ming. I replied, "Ming refers to the decrees of Heaven.
It has nothing to do with people's actions." "If people's actions do not
constitute ming, I beg to ask what about people's actions?" I responded:
"By [their actions] they may be preserved or lost; by them they may live or
die. [Still,] that is not ming. Ming refers to what cannot be avoided."

A second passage from the Mystery echoes the last line of the preceding
statement with one important change; it substitutes "time" for ming or the
Decree, saying, "TIME IS WHAT CANNOT BE OVERCOME." And a third passage
repeats the association of ming with time in defining the Decree as "what
is timely or not."

YANG HSIUNG'S first statement about ming suggests that "fate" is an
adequate translation for the term if we do not invest it with supernatural
overtones. Ming in referring to time (meaning "present circumstance" as
well as "opportune time") describes the involuntary and imposed part of
human existence that will not change through individual effort. [NYLAN,
pages 39, 40]

The early Chinese assumed that the transition from primordial chaos to
civilized order represented successive stages of increasing
differentiation. In effect, the Chinese argued that the world as they knew
it had evolved by a process analogous to human attempts to identify,
demarcate, and name significant geographical, political, social, and
religious boundaries. [NOMES OF EGYPT TO NOMOS OF GREEKS BUT IS THERE SUCH
FOR SAPIENCE?]From this they concluded that there existed in the primordial
Tao a divine basis for the development of the various human orders. Some
Han thinkers even argued that humans engaged in the search for intrinsic

continual ordering and reordering of categories. This helps to explain why
categorical thinking and correlative thought figure so largely in Chinese
philosophical writings. [NYLAN, page 68]

Among modern translators, no consensus exists about the proper definition
of ming; the term is most often rendered as fate or Decree (as in my own
introductory remarks), but it is also translated as variously as "duty,"
"destiny," "predestination," "causal connections and their possibilities,"
"manifestation of Heaven's will," "the inevitable," "empirical facts,"
"created world," "lifespan," "objective circumstances," "circumstances
beyond human control," and so on. The problem is not simply one of
translation. Any Chinese of YANG HSIUNG'S time would have found a
bewildering array of usages for the term, some mutually contradictory. In
part, the confusion stemmed from a typical feature of Chinese classical
philosophy, in which rival thinkers consciously used the same terminology
to articulate significantly different ideas. But there were also
unconscious adoptions of meanings through conceptual overlays and
etymological extensions as the so-called "Hundred Schools" of philosophy
emerged from the earlier religious matrix.

root as "ANKH" and, further, because the sandal was a part of one's daily
life in ancient Egypt and the ANKH sign came to symbolize life. This theory

cross of Egypt is a TAU CROSS that is topped by an inverted tear shape and
associated with MAAT, the goddess of Truth. It also represents the *SEXUAL*
*UNION* of ISIS, the Egyptian archetypal wife and mother, and OSIRIS, the
Egyptian god of life, death, and fertility.”

The association of the ANKH with the *MIRROR* was no chance occurrence. The
Egyptians believed that the afterlife was a *MIRROR* image of life on earth
and *MIRRORS* were thought to contain magical properties. During the
Festival of the Lanterns for the goddess Neith (another deity seen with the
ankh) all of ancient Egypt would burn oil lamps through the night to
reflect the stars of the sky and create a *MIRROR* image of the heavens on
earth. This was done to help part the veil between the living and the dead
so one could speak to those friends and loved ones who had passed on to
paradise in the FIELD OF *REEDS*. The ANKH represents the *MALE* *AND*
*FEMALE* *GENITALIA*, the *SUN* *COMING* *OVER* *THE* *HORIZON*, and the
union of heaven and earth. This association with the sun means that the
ankh is traditionally drawn in *GOLD* - the color of the sun - and never in
silver, which relates to the moon. Deities such as ANUBIS or ISIS are often
seen placing the ANKH against the *LIPS* of the soul in the afterlife to
