One Killer Clown Fiend walked free yesterday but his two co-accused
were found guilty of murder after a 51⁄2 week trial in New Plymouth.
Rhys Fournier turned to give a kiss and hug to his two friends before
walking from the dock at the High Court. Jurors in the body-in-the-
garage trial left the courtroom about 1pm to consider their verdicts,
returning just after 6pm.
They found Fournier's leader, Mikhail Pandey-Johnson, 23, and his
"protege" Karl Nuku, 19, guilty by a unanimous verdict of the hammer-
killing of Dean Browne on January 21 last year.
The three called themselves and their associates the Killer Clown
Fiends, and sported clown-motif badges and favoured colourful and
bizarre clothing.
The jury accepted the Crown's case, that Pandey-Johnson was the murder
mastermind and Nuku carried out his bidding to bash to death the man
who was causing them grief by wanting back his money in a drug deal
that turned sour.
After Mr Browne was bludgeoned to death as he slept in a flat on
Oriental Parade, Wellington, the two drove through the North Island
with his body in the boot of Nuku's white Toyota then dumped it in a
New Plymouth garage. But they denied they killed him.
Instead, they pointed the finger at Witness 29, the woman described as
being under the spell of Pandey-Johnson. Her identity was suppressed
at the beginning of the trial.
For the first time in the trial, Fournier, the man variously called
"Denim Dude" and "human wallpaper" responded with relief and tears.
Fournier was released on bail to stay with his mother in Kilbirnie,
Wellington, until he next appears on drug-related charges.
A large number of police and lawyers joined family members in the
public gallery to hear the result of the 18-month- long Operation
Drake.
As soon as the jury foreman delivered the verdicts to the court, about
6.30pm, Fournier's mother, aunty and older brother rushed from the
court, followed by Nuku's distraught mother, Susan Nuku and his
sister.
Mr Browne's shell-shocked mother and stepfather, Faye and Ron Bishop,
of Henderson, sat in the court until well after the court cleared,
supported by Crown solicitor Cherie Clarke and New Plymouth
detectives.
On leaving court, Mr Bishop told the Taranaki Daily News they were
"shocked and bamboozled" by the not-guilty decision.
Pandey-Johnson's mother, Veena Pandey, one of the family members who
has spent every day of the trial in the public gallery, declined to
comment as did his lawyers Paul Keegan and Peter Brosnahan.
Nuku's lawyer Julian Hannam said his team would be looking at all
options, including the possibility of an appeal.
Earlier, Justice Mark Woolford, of Auckland, thanked the jury,
acknowledging the disruption to their lives. He released them from
jury service for the next five years.
Detective Senior Sergeant Grant Coward said Operation Drake began
after the discovery of Mr Browne's decomposing body in the Drake St
garage in New Plymouth. "It's been a very complex and demanding
investigation which has taken us all over the North Island," he said.
At its height, the homicide inquiry had a staff of 40, most from New
Plymouth, but also involved Wellington and Auckland detectives. Pandey-
Johnson and Nuku are to be sentenced on July 29.
Mr Coward was last night unable to say whether Witness 29 is to face
charges related to the death of Mr Browne, saying it was a Crown
matter.
She admitted to police that she injected the fatally-injured Mr Browne
with a large dose of morphine. She was declined immunity from
prosecution but given an undertaking by police she would not be
charged with drug taking or drug dealing.
The Crown is today asking Justice Woolford to give her permanent name
suppression.

I was called for jury service for this case but not picked, given the
extensive list of witnesses I was rater pleased on one hand, but could
have got paid over 1K to do the job, hard to decide really.

Yep, A family friend made the comment recently after not being able to
escape jury service that "$Diety help you if you ever end up in front of
a jury of your 'peers'". The ones that want to be there have nothing
better to do with their time, and the others that didn't manage to get
excused just want to get the hell out their as soon as possible. And
they are deciding your fate.

As I did not get picked, and did not follow the trial in its entirety
(I listened to a witness list where I lost count at 50 so did not
think I would keep up by the totally truthful newspapers (joke) so I
have no idea what I would have voted. I was interested in their
choice of jurors, all women bar the last two males, but by that stage
they had all used up all their challenges, the women from memory were
all in their 50's or so, an older guy and a young guy last minute when
it was discovered one of the selected jurors had kids at school with a
leading detective in the case. I could not think of the logic by this
type of jury, I have posted before a lawyers logic for the jury he
would try and pick when defending an alleged rapist or if he was
prosecuting an alleged rapist, and whilst I was amazed, his logic was
sound when explained, but this particular jury baffled me. I was also
kinda pleased not to be picked as too many local witnesses, NP is too
small to piss junkie mates off. Im still waiting for my cheque just
for turning up. They also would have made a fortune as dozens of
people at roll call where absent, the fine for this is substantial.

According to the info provided when you are sent your call to Jury
service, if done for that length of time, during office hours, it
would add up to over a K, thanks Greg, I would of course declared it,
are you going to persist in this interfering in my life despite my
apologies, I would just like to know what I can look forward to.
Considering your constant reference to my size and appearance, it
would seem I have been the bigger man by even considering an apology
with not even a response.

Ps Greg, I hope you are up to date with the earning provisions within
different benefits, whilst I must still declare any income, I am now
entitled to earn $100 gross per week with no effect on my income, then
after that I dont have the doc next to me, but there is another limit
whereby less than 50c per dollar is deducted, then again another
limit, not sure of how much before a larger amount per dollar is
taken, per week all of this is, so the trial took five and a half
weeks, why dnt you go to WINZ get the relevant up to date info and let
me know how much I would have been making a week if I had been
picked. Saves me the hassle of wishful thinking.

I have re read your post, and must now state that your comment is
completely incorrect, I would have recieved any monies owing by
cheque, bank cheque made out to myself, deposited it in the bank and
taken a copy of cheque and bank statements for WINZ to do the
calculations, elsewhere on this thread I have explained the way it
works, the only thing I do not currently have at hand is the amount
(after the allowable $100 per week gross, yet still needing to be
declared) that the benefit dollar drops in set increments, and I didnt
make the rules. I appreciate you looking out for me, but suggest that
you get up to speed with the changes at WINZ, they chop and change
like the petrol prices, but thats fine by me, I have the document, I
have never lied to WINZ about income, no need to, if I was making
squillions I would have been off the benefit, I have been on same
benefit before and returned to employment against medical advice, but
delivered a quality service whilst employed with glowing references,
and when my medical conditions became unbearable (have you ever
experienced chronic ongoing pain?) I have returned to the benefit,
until I get the steam up to give it one last shot, eventually I may
not be able to work again, with a combination of WINZ and ACC input,
everything has been done that can be done for the conditions (so you
see, my madness is not why I do not work) it is physical, but I will
be happy knowing that whilst I could have remained on the benefit for
in excess of 20 years, I did my damndest to work as able, and on two
occasions (whilst NOT employed by Taranaki DHB) I secured the
contracts issued by the tdhb to provide the service I and my team
mates provided. Care to elaborate further, save me doing all the hard
work.

well the only reason I didnt want to be picked was because NP is a
small town, and with a witness list in excess of 50, and a large
number being local and not quite so local, if the jury (of 12) had
delivered the "wrong" verdict in the eyes of the individuals watching
the jury, recrimination may well have ensued. There were only a couple
of people who groaned when called and no challenged, one being the
younger guy, and yes, several people sighed with relief if challenged,
or as in the vast majority of us, not called.
Actually I still dont think the method of randomly picking names is
all that flash, the tiny little box spun round and round, wasn't it a
game show like Its In The Bag that was put into question as their not
so tiny little box was clear perspex, and it was apparent that a lot
of the "entries" were not being mixed, but by centrifugal???? force,
clinging to the inside of the contraption. As they used to use a
similar method to call Bingo, when at loose end and needing spending
money, I took a second job calling Housie (do not piss off the old
ladies y calling the wrong number!!!!) I was plonked in front of a
mono coloured (green lettering) screen, to me it looked like the
screen you get with windows, if you want to run it in safe mode, like
the DOS prompt, and somehow the numbers were randomly popped in front
of me, one after the other, all in the same place, and the only way I
could double check was to look at the screen the players used to
double check if they had missed a number, instant head ache as I had
to focus on screen, then miles away, then I started getting brain
freeze and panicking that I had called 32 not 23 and there was no way
of going back, plus the hosts set the tempo, I notice they never
called, I packed it in after a few months, totally doing my head in
vision wise, and the odd time I said the wrong thing I was ready to
run for the hills as about 300 angry women with dobbers were baying
for my blood!! But all part of lifes rich tapestry :)
