ALBANY COUNTY, N.Y. — Anti-violence advocate Dontie Mitchell was
arraigned Wednesday on new charges, including attempted murder.
Those charges stem from a deadly August shooting in Cohoes.
Mitchell spoke to us from jail on Wednesday about this new
indictment against him, which comes nearly two months after a judge
tossed out the original second-degree murder charge against him due
to insufficient evidence.
"What I can tell you, I didn't provoke it, I didn't instigate it, I
didn't start it," Mitchell told CBS 6. "Two young men that was a
part of my money gang youth empowerment program were out in Cohoes
and I went out to get them, and it's an unfortunate situation
happened."
"I just went there to see and talk, and I had nothing to do with
anybody getting hurt."
Now, the Albany County District Attorney's Office wants him for
attempted murder in that same shooting, but Mitchell's public
defender Rebekah Sokul said the indictment doesn't reveal who he's
accused of trying to kill.
"This new indictment certainly raises some questions," Sokul said.
"I'm sort of interested in seeing the new theory. It's very hard to
tell what the new theory is because the individual my client is
attempting to kill, that individuals name is blacked out."
We asked Mitchell who he think they're trying to accuse him of
killing. His response:
"I think it's obvious," Mitchell said. "Why they're not giving this
information is telling. They're trying to say I'm responsible for
attempting to kill somebody who on surveillance footage was
responsible for this entire incident."
Sokul said releasing the video is, "not in my purview, but something
that I think would she a lot of light on what actually happened."
We submitted a freedom of information request for that surveillance
footage.
Mitchell was pardoned by former Governor Andrew Cuome and released
from prison in 2021 after spending 24 years behind bars. Since then,
he's been an advocate for anti-gun violence.
We also reached out to the Albany County DA's Office for a statement
on why they're pursuing these new charges, but a spokesperson told
us they're not going to make any statement on this case at this
time.
