NY DOH Releases First CMP Funds

The NY Department of Health (DOH) has released the first Request for
Applications (RFA) for the use of Civil Money Penalties. The RFA is
available to nursing homes only and is limited to a specific issue -
the reduction of pressure sores - using a specific health information
collecting device. The DOH Website page with information on the RFA

LTCCC is very disappointed in the decision to use CMP funds in this
way. While pressure sores are a critical issue for nursing home
residents in New York and nationwide, nursing homes have a legal
responsibility to prevent them (not to mention a moral
responsibility). Because nursing homes are professional caregivers,
receiving large sums of tax payer dollars to provide care (including
prevention of pressure sores) we think that it is outrageous that
nursing homes which fail to do this should be considered for any type
of award. They should be required to use their own resources to
develop and execute a plan for correcting their problems. This plan
should be closely monitored.

LTCCC is currently engaging DOH to issue an RFA that is more in line
with the recommendations from our national study and the priorities
identified by stakeholder in New York State at our Stakeholder Summit.
