If you have not yet heard, on January 12, 2026 the Supreme Court of the United States (SCOTUS) denied our petition for a writ of certiorari, regarding Beyond Nuclear versus NRC. We had petitioned for a writ of cert. on October 31, 2025, asking SCOTUS to review erroneous rulings by the U.S. Court of Appeals for the District of Columbia Circuit, re: our various legal challenges against the U.S. Nuclear Regulatory Commission's (NRC) approval of Holtec International's license to construct and operate a highly radioactive waste consolidated interim storage facility (CISF) in southeastern New Mexico. At up to 173,600 metric tons of irradiated nuclear fuel storage capacity, it would be the largest highly radioactive waste dump on Earth.

An important part of our resistance is trying to put the brakes on large-scale shipments of highly radioactive waste, on roads, rails, and/or waterways through most states in the Lower 48, bound for these CISFs in the Permian Basin of New Mexico (Holtec's) and Texas (Interim Storage Partners'). Our slogans (and who coined them) against such high-risk shipments include: Mobile Chornobyls (Michael Mariotte); Floating Fukushimas (me); Dirty Bombs on Wheels (Mary Olson); Three Mile Islands in Transit (Kay Drey and me); and Mobile X-ray Machines That Can't Be Turned Off (Lauren Olson).

Thus ends our decade-long legal challenge, which we maintained through many long years of NRC licensing proceedings, as well as many long years of federal appeals court proceedings. We legally resisted Interim Storage Partners' CISF in west Texas (with a storage capacity for another up to 40,000 metric tons of irradiated nuclear fuel), just 40-some miles to the east of Holtec's CISF site in New Mexico, as well, in NRC licensing proceedings, and in federal courts of appeal, at the very same time. Although our resistance to both dumps is ongoing, our legal challenges are over, for now. 

It has been our honor and privilege to work that whole time with a very broad and diverse national grassroots coalition. Although our coalition's many federal legal efforts did not prevail in nullifying NRC's approval for both CISF licenses, they nonetheless helped buy the time, and demonstrated the strong widespread resistance, that was needed for the hard-won passage of state laws in both New Mexico and Texas, which have effectively banned both dumps.

But we still have some bills to pay, which is why I'm writing to you now. Beyond Nuclear still owes around $6,000 in reimbursements for SCOTUS printing expenses and filing fees to one of our otherwise pro bono attorneys, and around $5,000 in outstanding invoices for services rendered by our second attorney.
