ST. JOHN'S - Court officials in Newfoundland disagreed
with those in Pennsylvania about the wisdom of letting
Dr. Shirley Turner free on bail pending her trial for
murder.

In hindsight, the U.S. judge was right.

Turner drowned her 13-month-old son and herself last month
in what police in St. John's have called a murder-suicide.

At the time, she was free on bail while fighting extradition
to Pennsylvania on charges of murdering her former lover.

New court documents released after a publication ban was
lifted show that Newfoundland Justice Gale Welsh believed
Turner, 41, wasn't a threat to society, despite the murder
charges awaiting her in Pennsylvania.

Turner's former lover Dr. Andrew Bagby, 28, was shot five
times in a parking lot in a state park in Pennsylvania on
Nov. 5, 2001.

Investigators traced Turner's movements between Nov. 4 and
Nov. 6 using her cellphone records. They say she drove from
her residence in Iowa to kill Bagby, then went back home.

Her cellphone records also showed a number of calls days
earlier to Bagby's new girlfriend.

She fled to Newfoundland, where she had family, shortly
before police in Pennsylvania issued a warrant for her arrest.

Nonetheless, Justice Welsh didn't believe Turner was likely
to run away and released her on $75,000 bail while she
appealed her extradition order.

Prosecutors in Pennsylvania warned the Newfoundland courts
that Turner was potentially violent and a suicide risk.

The court documents say Turner attempted to kill herself in
1999, at the end of another relationship .

Turner and Bagby met while both were medical students at
Memorial University in St. John's. They carried on a
relationship, until just before Bagby's murder.

Investigators in Pennsylvania say Bagby dumped Turner
who was pregnant with his child.

Several months after she fled to Canada, Turner gave birth
to Zachary.

Bagby's parents came to Newfoundland from their California
home to be near their new grandson.

for 2 years and was totally pissed that she killed her son. Sure kill
yourself if you want but not a innocent kid who could be loved by someone

If she was a man she would have been gehind bars. Women get it easy when it
comes to our judicial system. When they do go to prison they live it up
like they are living in a condo. This should open some peoples eyes and
make them realize how easy women really have it when it comes to committing
violent crimes.

Justice Welsh has the similar age as Turner.

Barbara Gale Welsh, Q.C. of St. John’s, is appointed a Judge of the Supreme
Court of Newfoundland, Trial Division, in Corner Brook. She replaces Mr.
Justice Denis M. Roberts who has been appointed to the Court of Appeal of the
Supreme Court of Newfoundland.

Madam Justice Welsh graduated in Law from the University of Saskatchewan in
1983 and was admitted to the Bar of Saskatchewan the following year and to the
Bar of Newfoundland in 1989.

Prior to her appointment to the bench, Madam Justice Welsh had been a solicitor
and a counsellor with the Department of Justice of Newfoundland and Labrador,
and had mainly practised in the areas of constitutional law, human rights law,
and natural resources and education law. From 1984 to 1989, she practised law
with the Department of Justice of Saskatchewan, Constitutional Law Branch.
Prior to that, Madam Justice Welsh was a teacher and taught grade school and

is the "liberal" justice system at work. I believe we should get back to a

one more thing that is being over looked here folks is that the
Childrens Protective Services department was notified of a possible
danger to the child and a recommendation of supervised custody was asked
for.....however nothing was ever done about it......

my samantha once cut her chin while under the care of our sitter and i
had to fill out 5 or six pages of very direct questions with a young
socail worker type girl that pratically accused me of abusing me....i
told her that i understand that she was doing her job but that I or my
sitter had not hurt my child, she was very forceful in directing me that
all precautions needed to be followed to determine if in fact the child
would be returned to a potentially abusive parent of
guardian.....!!!!!! what the frig happened here??????????

there needs to be an indepth revue and inquiry to make sure this never
happens again......EVER to another innocent child.....i applaud the
Bagby's for their fortitude...

The Canadian court system is a mess.
This Judge made the biggest mistake for all involved.

Unbelievable what happened in this case. At first I was under the impression the Canadian court system didn't have all the information about Turner's past mental instability but it looks like US authorities actually provided them with her full history so there is no excuse EVEN IF you take the position that being accused of murder isn't enough to deny bail. Somebody should have done the world a favor and wasted Turner before she was able to kill another innocent person.

How is this possible, I am not a person who is easy shocked. This story made me feel physically iI'll. It shook me to the very core. Such gross incompetence is in excusable. In my opinion this Judge should be serving time. The fact that she didn't resign after being so wrong jyst further proves her bad judgment. I would have resigned to protect the public from myself. Instead she seems to have a you win some you lose some mentality. She makes me sick.

As I think everyone notes, the real fault of this is the arrogance of "judges". Whether it's prosecutor, defender, or judge, attornies in general seem to have an idea that they know all.

The arrogance of judge welsh is especially appalling when you read what she note. In short, she acknowledges the crime, but still releases the woman, doesn't question her guilt or innocence and release on the basis of innocent until proven guilty, but rather, because the violent crime wasn't directed against the public in general. She gets a hall pass if she says it appears the crime wasn't committed and release on that basis, but, to say, in essence, I think she committed the crime, but am releasing her to care for her child because her violent crime wasn't against the public in general is almost beyond belief. Judge Welsh does deserve to be relieved of duty and debarred, She clearly isn't capable of forming rational thought, just as the killer mother couldn't grasp the reality that it is wrong to kill another when you are angry at them.

To make matters worse, had Welsh done any sort of diligence to form the basis of her opinion of no psychological issues with the mother, she would have quickly found there to be very significant evidence of psychological issues in the mother; all she would have had to do is call the prison the mother was being housed at. Welsh chose she must have thought of as her own divine omniscience over fact, like many judges and prosecutors do. Literally, a fifteen minute phone call saves Zachary's life. Or, maybe even less, taking 10 seconds to have your assistant call the jail, saves Zachary's life. This lack of any sort of diligence is what you should be held accountable for.

In the end, clearly the mother was suffering from mental illness. She in essence was failed to by her doctor, the judges, and the system. Despite the fact that the movie portrays her as horrible, I think everyone can agree this was a person that was not rational and as a result needed some heavy intervention that was never delivered.

Because of this, I lay the fault of Zachary's death not on the mother, but rather, on judge Gale Walsh, who by virtue of her position, neither has any evidence of psychological disorders.......

Judge Walsh, you owe everyone involved an apology, and especially an apology to that great couple David and Kate. If you have any sense of right and wrong, and ay sort of ethical underpinning in your approach to your life and profession, you would also immediately resign. I don't know how you live with yourself and carry on as if you are worth of the seat you sit in. SHAMEFUL!

Completely agree dcave... what is her email - please post so that everyone that has seen the movie or heard the story can email Welsh and request her resignation. Unimaginable that this woman wasn't, at a minimum, kicked out.

Better yet, what is the process to impeach a judge in NF? The basic issue is this, changes the laws all you want, but the only way to get bureaucrats to change their behavior is to let them know they can and will be removed, and, potentially charged for acts of extreme negligence such as this.

I just finished watching "Dear Zachary". I was saddened, appalled and filled with respect for Kate and David. I cannot believe that the judge Gale Welsh was permitted to continue her career. Seems to me she should have been held responsible for the death of Zachary. I lost my oldest son 5 years ago and watching the strength of Kate and David amazed me. They are truly wonderful people who deserve much respect!!! Although, I am saddened over the circumstances of the losses Kate and David endured, I must say that "Dear Zachary" is one of best movies I have ever watched!! It filled me with a spectrum of emotion.
