They are able to associate if you use latest ns-3 version, management frames are now sent at a basic rate as per standard.
However, since 802.11ax is only supported with constant rate, you will have to specify a VHT rate in your constant rate manager settings.

Any plans of extending ApWifiMac and WifiRemoteStationManager so AP can use different DataModes depending on the STA capability?
