The House passed a bill today that would take
away states' rights to determine whether an
interstate gas pipeline complied with section 401
of the Clean Water Act. It's hard to imagine it
passing in the Senate, but, if it does, this is
how the Constitution Pipeline gets built.

(e) WATER QUALITY IMPACTS.—
(1) IN GENERAL.—Notwithstanding section 401 of
the Federal Water Pollution Control Act (33
U.S.C. 1341), an applicant for a Federal
authorization shall not be required to provide a
certification under such section with respect to the Federal authorization.
