Further to your communication dated 23.11.2017 , it is submitted that the hearing before the Hon'ble National Consumer Disputes Redressal Commission, New Delhi, in CC/351/2017, on 15th November, 2017, was attended on our behalf by Mr Vishwanath Shankar. So only Mr. Vishwanath Shankar knew what transpired in the Hon'ble Commission on that day.
After speaking with Mr Vishwanath , I state that the contents of your letter dated 23.11.2017 is not quite accurate. It is vehemently denied that in the presence of the presiding officer the two sides had agreed that both sides shall strive for settlement. It is also denied that substantial progress towards completion of the project has been made. In fact even as on date the project is nowhere near complete and it does not look that the project will be complete anytime soon.
On the contrary, during the court proceedings that day, your advocate requested the Hon'ble Commission that the matter should be referred to mediation which was turned down by the Hon'ble Commission and instead a date for final hearing was fixed in July, 2018. This means that the case is now in its final stage.
It is only after the hearing and outside the court premises that there was a brief discussion between Mr Vishwanath and the representatives of Nitesh Estates and the counsel representing Nitesh Estates. In the discussion Mr Vishwanath had told that the complainants are willing to talk to Nitesh Estates to work towards a compromise/settlement, provided Nitesh makes an offer of suitable compensation and hand over apartments to the buyers by which is acceptable to them.
In this regard it is stated that the buyers are willing to talk towards a compromise/settlement , provided a decent offer of compensation comes from your side which is acceptable to all buyers.
As far as the compromise/settlement talks are concerned, we will authorize and nominate our core team Mr Vishwanath S., Mr. Rajesh Tiwari, Mr.Mahesh Hegde and Mr, Satish Yadavalli ,to talk to you on our behalf. Any offer of compensation made by you, will be communicated by them to all the buyers after which the buyers will take a call whether to accept your offer or reject it.
