I am interested in hearing about your personal experiences with some of the
portrait studios in and around the St. John's area. I normally use Dominion
portrait studio in Mt. Pearl but they are booked up until Christmas (waited
too long this year to try and book an appointment). I haven't had decent
results with Walmart, so I am looking for options other than Walmart.

You should keep trying the portrait studio in Mount Pearl. There are always
cancellations. Also, Dominion has two other portrait studios... one on
Blackmarsh Road and one on Stavanger Drive. I know that the one on
Blackmarsh Road is not booked up.

If you don't like the results from any portrait studio, that's what I'm
here for. I do post-processing and image improvement. :)

I had photos taken at Vatcher Photographic its on Duckworth. Its a fairly
new spot but they do awesome photos. They are a lil bit more than walmart
and places like that but is not unreasonable. my grad package was 30 bucks
and it came with an 8x10, two 5x7 and 8 wallets.

If you want photos done email me. I have been in business for 2 years and
worked with another company in Paradise for 2. If you want the convenience
of in home shoot, let me know. My company is set up to allow for location
shooting as I photograph weddings every summer. Have the comfort of being at
home for the entire shoot. You get low res CD of photos and contact sheet of
all prints. We provide a minimum of 6 proofs, depending on your needs. We
allow for many poses and allow for up to 3 changes of clothing.
I have 300+ digital backgrounds to choose from.

infringement?? If you manipulate another photographers work in whole or in
part you are in violation of copyright laws and could be subjected to
rigorous fines and court cases. It would be in your interest to no longer
manipulate any professional or copyrighted material unless you are willing
to pay steep fines and or jail time.

I am quite aware of copyright infringement, and I am specifically aware
of this section of the Copyright Act under Ownership of Copyright which
you may not be aware of .....

(2) Where, in the case of an engraving, photograph or portrait, the
plate or other original was ordered by some other person and was made
for valuable consideration, and the consideration was paid, in pursuance
of that order, in the absence of any agreement to the contrary, the
person by whom the plate or other original was ordered shall be the
first owner of the copyright.

..... in other words, if someone pays you to take their picture, the
person who paid for your service owns the copyright-- not you. The only
way you get that copyright is if the person who pays you legally signs
over the copyright, which is covered under section 3 of Ownership of
Copyright.

Perfect amount, the little one is a little less than 2 years old and I
already have massive amounts of extra pictures that were not needed but came
with the package. Sounds like just enough pictures.

You are mistaken. A professional photographer has the copyright of each
individual photo/negative that he or she takes. The only time this is not
the case is when they are working with a company as an employee, whereby the
company owns the copyright. Just because a person pays for photos to be
taken does not give them copyright. They are paying the photographer for his
services not for the original photos or negatives.
You may need to look these up and get some consultation from a lawyer. You
have misinterpreted the paragraph you posted.

The Copyright Act does *not* make that distinction, sorry, what the
Copyright Act does say is any valuable consideration (money or trade,
employment by company or person is irrelevant) automatically gives the
person who hired your services the copyright.

Here is another source, this one from canphoto.net which a large,
reputable AND professional only photographer resource. If you like, you
can also pick up copies of legal release forms there which *have* been
reviewed and okayed by Canadian copyright lawyers.

That's just so much bulls..t
If you enter a contract with someone and the contract says that the
photographer retains the copyright, then they have it. Otherwise it's
the person who it was done for. Don't confuse it with a scenic or
abstract photographer who is selling his wares, etc. That's a different
matter.

How about a list of all the people that were fined, jailed or other wise
hung, etc. that you mention. If you post the stories I promise not
to copy them.

I'm with snapshot.

Whoever records (neg/slide/digital) the image owns it and any and all
rights to copy it (copyright).
