Hells Angels win in court
Outlaw bikers don't have to reveal financial records, offshore
interests

Dozens of high-profile B.C. Hells Angels, associates, wives and
girlfriends have succeeded in getting the taxman to withdraw demands
for detailed financial information about their earnings and assets,
including any "hidden" outside the country, The Vancouver Sun has
learned.

Law-enforcement agencies are increasingly going after the assets of
gangsters in an effort to combat organized crime. The decision to
withdraw the demand for disclosure in the Federal Court case would
appear to be a setback to these efforts.

The two-year court battle apparently inspired a similar tactic by the
notorious United Nations gang, which is also challenging demand
letters issued by the Canada Revenue Agency.

The UN case, filed in April and including two gangsters who have since
been shot dead, cites the Federal Court case of Brian Airth against
the minister of national revenue as precedent. Both cases allege
police and the revenue agency colluded and improperly shared
information as part of a joint strategy to target the proceeds of
organized crime.

The 42 related Hells Angels cases were originally filed in August 2006
by full-patch members of the bikers' chapters -- the Nomads,
Vancouver, East End, Haney, Mission City, White Rock and Nanaimo,
according to documents obtained by The Sun.

The cases were consolidated and a new statement of claim filed against
the government in January 2008.

The statement of claim says Airth, listed as a full-patch Haney Angel,
and others linked to the infamous motorcycle gang want a declaration
that the revenue agency "has engaged in a continuing course of illegal
conduct by targeting the plaintiffs through an initiative variously
known as 'Project MOGAL,' the 'Hells Angels Project' or the 'HA
Project.'"

"The Plaintiffs are all members, spouses of members and associates of
the Hells Angels Motorcycle Club," the court documents say.

"The HAMC is the target of ongoing criminal investigations by the
RCMP, The Vancouver Police Department, and other police services in
British Columbia, including the Organized Crime Agency, the Combined
Forces Special Enforcement Unit and the Criminal Intelligence
Service."

East End chapter president John Bryce complained in his affidavit that
after the CRA probe began "I have had considerable difficulty with my
banking."

He said he was kicked out of the Bank of Nova Scotia after 27 years as
a customer.

"I then transferred my business and personal accounts to North Shore
Credit Union. The same thing happened," Bryce swore. "I have now
transferred my banking to a trust company. I fear that the same thing
will happen again. I believe that there is a direct connection between
the police, my problems with CRA and my banking problems."

The claim, filed by Vancouver lawyer David Martin, also says the Hells
Angels want a declaration that the CRA violated the Income Tax Act by
passing confidential information to "third parties, including the
police."

Like the UN case, the Hells Angels allege their Charter rights were
violated by the CRA letters sent out between 2004 and 2006.

Hells Angels Vancouver president Rick Ciarniello says in his affidavit
that Vancouver police biker specialist Sgt. Larry Butler stopped
outside the East End Clubhouse in 2004 and said to a number of
members: "The tax guys are going to get you all."

"It seemed as if he was running the show and directing the tax guys to
come after us," Ciarniello said.

He also said one CRA official told Angels that the government wanted
"the location of hidden assets such as property owned in foreign
countries or held under another person's name."

The nature of these demands for hidden assets further strengthens my
belief that this is a criminal investigation that is being carried out
by the CRA under the direction of the police," he said.

Despite the heated rhetoric and apparent impasse, an out-of-court
agreement was mysteriously reached on the same day the Federal Court
challenge was to be heard this spring.

The CRA backed down and revoked "the letters of requirement" and the
case was withdrawn despite the lengthy tax probe that generated
thousands of pages of file documents and hundreds of hours of court
time.

None of the Justice Department lawyers who worked on the Airth case
were available to comment about why the government would withdraw the
requests years after they were issued.

Martin, the Hells Angels lawyer, did not return phone messages left at
his Vancouver office.

Nor did Ciarniello, longtime gang spokesman, respond to a request for
an interview about the apparent success of the group's court
challenge.

CRA communications manager Bradley Alvarez said confidentiality laws
prevented him from commenting on any audits or actions being taken by
the revenue agency against any individual.

"We can't comment on individual cases because of the privacy
provisions," Alvarez said.

He said that goes for "any of our enforcement activities with the
Special Enforcement Program -- for the most part they are civil
activities -- which are covered under the Privacy Act."

But in its response filed in Federal Court last February, the
government said the CRA's Special Enforcement Program does in fact
target HA members and others believed to be involved in organized
crime, but does not violate any laws by doing so.

"[The minister] admits that the SEP targeted individuals due to their
association with the HA, among other outlaw motorcycle gangs, but says
that this was because this was founded on the CRA's suspicion that
members of those gangs may derive income from illegal sources," the
government defence says.

"SEP officers relied on information from the Vancouver Police
Department and the Organized Crime Agency and on media reports of
arrests of alleged gang members to identify the persons who were
associated with the various outlaw motorcycle gangs in order to
determine who should be included in this review."

Yeah and like any citizen, they deserve to be protected from illegal
policing practises and over zealous tax vampires.

Here is a question for ya, how come the funds recovered from drug dealers or
drug enterprises are never preserved solely for the housing and life needs
(yes including the dope they also pinched in the bust given to the addicts
for free) of the dopers they have imprisoned. Then you would see a serious
drop in crime and it would quickly cut the throat the larger cartels in
Canada.

They do have this in common.

Both have collection agencies. Both sell drugs at a high premium. Both
live off of others. Both steal, at least it looks that way on my pay
cheque. Both have vehicles paid by others. Your business activities, they
want a cut. Both will punish you for not paying your dues.

Just that the Canadian government has far larger resources like cig/booze,
utility bills and gasoline to fund their control, much more lucrative.
Which makes them bigger and gives them more clout. And the government hates
competition.

On the Vancouver Sun website she reported on HA smoking pot at their
Langley compound and the various law enforcement agencies present
including from Ont. doing nothing about it.This has since been removed

I recall a millionaire HA businessman in Nanaimo having the same
problem. Good for the banks they should refuse this kind of business.
Ppl joining HA should know they are targets for law enforcement and
not welcome by the banking industry.

Alabama I have to pay taxes and all I got was the education that
allowed me to be employed and the transport infrastructure that gets
me to and from work and of course the money that helped develop the
Internet for me to spend my leisure time on and if a crackhead breaks
into my house I want to be able to dial 911 and get help.

nations? Lots of competition. HAMC hates competition but they haven't
defeated UN and the Outlaws and Vagabonds are in Ont.and of course the
Bandidos aka Mongols are doing there thing. Even in BC there are

It is only a crime by someone elses rule. Not that I would want it, but the
Hells Angels wrote the law governemnt of Canada would not exist and thus not
govern.

First, doctors. Licensed drug pushers. Sedate the old if they get fussy.

Second, cigarettes and alcolol. They both have exactly the same properties
but the government gets a 50% or higher cut. Not much difference in markup
than street drugs I bet.

is cast. plutocrat Dion or plutocrat Harpo. Or if you are fealing really

If you live in Alabama, you pay less than 1/2 the taxes I do. Last time I
was in Alabama, cigs and JD were about 1/5 the price of here. Gas was
cheaper too. I am also one of those rare people whole have lived on both
sides of the border, almost 10 years int he USA. Great country. Don't
believe the democrats on Canada for socialism.

I am not an anarchist, just don't like big expensive ever mothering
inefficient government taking more and giving less.

I doubt the HA is going to become the national governing party of Canada.
True about income taxes. But taxes come in all sorts of ways. My utility
bill was almost $300 last month, franchise fees, right of way fees, taxes on
tax fees and my furnace has been tuned off for 2 months. 50 cents of every
dollar at the gas pumps, more royalties and taxes to government. Ever tried
living through a Canadian winter with no income or heat? Alabama sounds
pretty darn good place to squat.

Now you are cooking. The non-obvious relationships between government,
corporations and gangs for control of the people. Manage PR and let them
think they are free, when in fact the truth is well managed.

Power and PR is what it is about. Get a HA mistress to sleep with a MP or
MPP for a little reminder. Wouldn't be the first time sex was used in
politics. Allied forces enlisted women to do this to the Natis in WWW II.
Serge Menard fell for an old trick. And the foreign embassy has had issues
in all sorts of places. What was the RCMP wistleblowers name in Hong Kong
where Canadian passwords were for sale with few if any questions?

It all ties together more than we realize. For now, we can just guess but
perhaps intime more will leak. But like the modern day Maffia, they do like
to keep the real truths on the QT.

I guess he didn't have enough grease. Could have had a call to a former
prime minister or MP with $300,000 cash, and got a Canadian government
development grant or something. You know, similar to the aircraft business
and the thousands of questionable business in Canada get each year. While
ficticious, it likely has occured in some form or another.

The real difference between organized crime and government, is who is
perceived to be in power.

HA has its own laws and they enforce them to varying degrees. They
consider themselves a nation. To be fair HAMC was officially opposed
to Quebec separatism and for the federal govt side in that one.

They can prescribe medications they don't sell it. Doctors are not the
govt they just get paid through the govt in most cases.

In the case of booze and tobacco the mark up is much higher than
illegal drugs. The govt doesn't sell tobacco just regulates it.

Too hot and muggy and lots of mosquitoes and the tornadoes and

Hard to get the truth with censored search engines like Google. If you
can choke off the money supply to any org you can severely damage
them. Sure some HAers wouldn't care as long as they had a patch and
bike and various gear with the HA logo but others if they lost their
business would quit it. Their ability to corrupt ppl would be weakened
without money being circulated through the banking system.
