The following is a bit long due to supporting documentation. Let me
summarize: You have a customer, Brian Kushner, who is apparently
spamming Usenet, and I respectfully request that you put a stop to it.
"Spam", in this case, is defined in the simplest form: we have more than
20 substantially identical posts to different newsgroups, one at a time,
by the same individual, in less than 45 days.
Please note I am not referring to any allegations that Mr. Kushner is
offering incentives to third parties to post on his behalf. The list
below contains only posts recorded as being made from his own accounts
on Prodigy and Netcom.
In all cases, there is a published Terms of Service announcement covering
Excessive Multiple Posting. Mr. Shaver, in your case the TOS of
Sprintlink takes precedence over arrangements you may have made with Mr.
Kushner.
For the record: I am neither a competitor nor a customer of PowerStar. My
only concern is the protection of Usenet and the upholding of appropriate
posting guidelines as they relate to net-abuse. Attempts to resolve this
matter amicably have been made and have been rebuffed.
I have no problem with on-topic commericial ads that are not excessively
multi-posted. But when Usenet spam is used to promote a commercial Web
site, I expect you to warn your customer, and give him a chance to modify
his behavior. If he is unwilling to cooperate, then I expect his
account(s) to be closed and his Web site(s) taken down in accordance
with normal standards of ISP administration.
