The purpose of this letter is to advise you that the use of the
trademark "Soft Targets" and whether on-line or by any other means
constitutes wilful infringement of our trademark, copyright, trade-dress,
and other intellectual property rights. It is clear that consumers are
likely to associate such use with "Soft Targets" and the "Soft Targets"
product, and to be confused about an association between our respective
companies --
which association does not exist, as you well know. Such use and
confusion will inevitably operate to the disadvantage of "Soft Targets"
and has the distinct potential to adversely affect the valuable goodwill
presently associated with the products of "Soft Targets".

Also a variant on the potential for trademark infringement --
unauthorized use of a confusingly similar mark -- is trademark dilution.
Dilution occurs when a trademark owner's trademark, or a similar one, is
used in such a way as to dilute or tarnish the distinctive quality of the
mark. It is not necessary to assess whether consumers are likely to be
confused into thinking there is an association between the unauthorized
use and the trademark owner, so it is not necessary for the goods with
which the marks are used to be at all similar for a court to find that
dilution is present.
